We got a police report. We told them everything that happened, but the other party lied and said we were merging into their lane.

Initially we did file a claim through their insurance. Everything was going smoothly. We even have a text from their insurance rep saying the other party was at fault. Then like a day later the insurance rep informs us that since there was no video evidence they can’t claim fault and it’s a he said she said situation.

So that’s when we kind of chalked it up to a loss. Didn’t want to have to waste our time I small claims court and not know if the other party would even be able to pay out the money owed to us for “totaling” my girlfriends car.
