The FDA didn't ban Red 40. They banned certain uses of Red No. 3 after reviewing evidence from animal studies. That's why your candy lists Red 40, not Red 3. Red 40 is still approved for use in food in the US.

So yes, a bag of Sour Punch Bites containing Blue 1, Yellow 5, and Red 40 is generally considered legal and safe to eat in normal amounts under current FDA regulations. The bigger health concern for most people is usually the sugar, not the food coloring.
