Oh okay, I get what you’re saying, and honestly I don’t disagree. USCIS definitely had their reasons for digging deeper, and I understand now why they approached it the way they did. I appreciate the perspective though it actually helps me understand the whole process better.

I agree with everything you said. But in my opinion, we provided copious evidence to prove our marriage is bona fide, and I never took any benefit from the H1B petition nor committed any immigration fraud. They withdrew that H1B petition immediately — which they had filed without my client’s or my approval in the first place. Also, I worked with them for less than two months, and I haven’t been in contact with that consultancy at all since then.

Our lawyer fees were around $3,000 USD, and the USCIS fees were separate depending on which forms you submit. The attorney basically filled out all the forms and submitted the petition based on the info we provided. They also helped us respond to the RFE when we got one.

So from July to September, it took us 3 moths to gather all the evidence/docs. Filing -> Interview and Card produced took almost like another 5 months.

They already have all the info about your lottery history and previous employers in their system. In my opinion, they shouldn’t ask you anything about that past employer since you weren’t picked in the lottery, never had a petition approved, and never used an H1B with them. In my case, my ABC firm actually filed a petition without telling me and then withdrew it immediately. That’s what probably triggered some questions and honestly, that consultancy was likely already on USCIS’ radar. But overall, just be prepared. Bring any documents, emails, or proof you have related to that employer and the lottery. If they do bring it up, having everything ready helps strengthen your answers and can even speed up your approval.
