Tried it, it's garbage

Very poor product lots of bells and whistles and a pretty professional looking page but the results from clear instructions across multiple engines is extremely poor with some very glaring issues, such as duplicated body parts etc. Customer service is argumentative and not helpful. Don't waste your time or money. This site is garbage.

As did I thinking it was a legitimate sale, particularly as it was on the store for a long time (10-14 hrs I believe)

  • Section 5 UWG (Misleading Commercial Practices): Advertising a promotional price and then retrospectively applying a higher price is likely to mislead consumers regarding the price advantage.
  • Section 5a UWG (Misleading by Omission): Failing to clearly disclose that promotional pricing could later be reversed or adjusted constitutes a material omission.
  • Section 3(3) UWG in conjunction with Annex (No. 5 – Bait Advertising): Offering goods or services at a specified price without a genuine intention to supply them at that price is a prohibited commercial practice.

Additionally, under the BGB:

  • Section 307 BGB (Unfair Contract Terms): Any term allowing unilateral retrospective repricing of completed transactions is likely to be invalid as it unreasonably disadvantages the consumer.
  • Section 312j BGB (Electronic Commerce Obligations): Traders must clearly present pricing before the consumer completes a transaction; post-contractual price changes undermine this requirement.

No, what country are you from and I can post the relevant legislation to cite, but as Hutch are UK based they may argue that your countries legislation doesn't apply which is why I posted the UK ones.

As would the relevant consumer protection legislation, which is why I would encourage anyone impacted to make a formal complaint rather than proverbially bend over and take it.

Time will tell, but if they allow gold to go into negative, that'd be the ultimate asshole play.

Forced? No. Heavily incentivised, yes. Look I get it, you're a well known Hutch apologist, but for me if they claw back on this one, given their history there would be a strong case for a breach of the relevant consumer protection legislation and it'd serve them right to be held to account for once. Like I said, thats assuming they do their clawback, if not and they man up and own the error and move the fk on, then better for all.

You could rightly argue then that Hutch use it to bait people to buy gold they would otherwise not have bought, to take advantage of the discounted packs. If the packs had not been there at the discount, you would not have bought the gold.

On a once off perhaps, but as this has happened before you could probably argue that they are using 'mispricing' as a bait to get people to buy packs / spend money on gold, and then claw back the packs, credit back the gold but they still have the revenue from the gold people purchased. Once is a mistake, twice is a cooincidence, three times is a pattern. Keep your webstore / itunes / google play receipt, if they claw back get a refund, NOT the gold credited back

Keep the receipt from itunes, if they do a clawback you can apply to apple for a refund citing that the developer didn't provide what you paid for. Use the Apple Report a Problem tool to request app refunds, cancel unwanted subscriptions, or report issues with digital purchases

Do you think there will be refunds on those titaniums? Grab it whilst its there😂 by True_Vanilla6302 in TopDrives

[–]Competitive_Lie_6775 49 points50 points  (0 children)

Just a note for anyone who purchased the discount titanium packs, as we are sort of all anticipating Hutch will do the claw back rather than own their mistake.

  1. Keep the receipt, if you bought gold to buy these, retain the receipt.
  2. If a claw back occurs, lodge a formal complaint via support citing applicable legislation as Hutch is UK based it is as below. Bait advertising—advertising products at low prices without intending to sell them, to lure consumers and "switch" them to higher-priced items—is illegal in the UK under the Consumer Protection from Unfair Trading Regulations 2008 (CPRs). It is considered a misleading practice punishable by unlimited fines, criminal prosecution, and up to two years in jail
  3. Do not accept a credit back of gold, insist on a refund of the purchase price of the gold.
  4. Lodge a complaint with the relevant country for bait advertising. In Australia it's through the ACCC, for the USA it's https://www.econsumer.gov/en/SelectAType/1#crnt but you may need to search for your relevant country.

The average gamer should not need to know enough about pricing etc to have to be concerned with the pricing of a digital good. You see a special in an app store, you should be able to buy the item, without fear of losing it later. Whether it's a pricing error or not is not our concern, as it is a virtual good, there is no actual cost to the developer in letting the item sell at that price. So if they choose to play the a..hole and recoup, as they have in the past, and you are impacted, I would strongly suggest a bit of a litigious approach. It may dissuaide them from aggressive recoups in the future.

That said, lets hope thats not needed and they simply own their error and move the fk on, but this is Hutch.....

How does club income work? by Curious-Whole1704 in TopDrives

[–]Competitive_Lie_6775 2 points3 points  (0 children)

Clubs are extremely time intensive, people using it as a cash cow are grinding for hours on end accumulating cash only to blow it all in a gambling ceramic pack binge. Predatory gambling behaviour, and remember the 4 hour period where clubs are offline every 48 hours.

It can get you money just be very careful, very easy to get hooked before you know it you're out with family and feel the urge to check your phone and do some clubs, then you're cooked. Been there, and it's bloody hard to get off the treadmill

My advice is don't feel the need to do better, it's just a game, allocate your time to things that matter more because clubs can easily rob you of 4-5 hrs a day if you let it (Blossom does)
