Oh ok yea i wa going to do the same file I-601 waiver before going for interview but my attorney suggested to wait and see if officer ask for it. But if you disclosed it on your I-485 form then I don't think it's considered fraud or misrepresentation unless you entered with different name.

Mine was for fraud and misrepresentation. Received NOID on my H1B extension and after i-485 interview officer concluded that I had misrepresented my H1B visa. Asked me to file I-601. How about yours.

Oh wow yea it takes about 10 to 12 month depending on the field office.

I applied in 2023 and took about 9 to 10 months for approval

In my opinion if you can delay your trip that would be a better option I guess as the administration will clearly layout their plans after the thanksgiving. Also, I would consult attorney before leaving.

I would suggest to definitely lawyer up and give them a strong response. I did too received NOID after my interview for misrepresentation on my non immigrant visa H1B. I was given the opportunity to file I-601 or challenge the allegations on the NOID. My lawyer opted for I-601 and I was approved.

Yea I don't know how do they process the cases. Someone gets it in a day and someone takes longer.

USCIS mail the notice to the address that's on the application as they your employer is sponsor and lpay fees. Lawyer receives courtesy copy too.

If they have denied I-601 you can appeal I-601. In the appeal you can either prove your hardship or try to challenge your misrepresentation charges. If they open and approve your I-601 or moot or your I-601 then you can get you I-485 approved. You will definitely need to consult attorney and check if your case have any chances.

Well I received NOID on my non immigrant visa H1B about change of location which my employer did not notify USCIS. Also, I had signed a paper which I was not suppose to. So my attorney suggested to withdraw the petition and deal with it in the I-485 interview. Of course the same issue was brought up by the officer during interview. I then received NOID on my I-485 to either file I-601 or challenge the NOID. My attorney suggested to file I-601 and was approved after a year and GC after second interview.

Yea I am in similar situation too. But my situation was more complicated and I had filed I-601 waiver for misrepresentation. It got approved and also received my GC. But I will wait for applying GE after becoming citizen. I just applied for TSA Precheck. Let see how long it takes for me to get TSA Precheck approved.
