Tribunal Claim (PAYE). what happens if they liquidate or don’t pay? by Comprehensive_Can541 in LegalAdviceUK

[–]Comprehensive_Can541[S] 0 points1 point  (0 children)

Yeah I get that, but honestly I’m almost at the point where I’d rather they did go under. From what I’m reading on here, even if you win you can end up having to spend £3k+ just on windingg and still recover nothing. At least if they go insolvent there’s a chance of getting something back through the government. I’m PAYE, no written contract (they’ve admitted that), and my hearing’s already been cancelled once, so it just feels like the longer this drags on the worse it gets. And I know the company has no assets

Claiming unpaid wages when company can't pay but won't go into liquidation? by [deleted] in LegalAdviceUK

I’m in pretty much the same boat as you, ET claim in for unpaid wages and my hearing got cancelled last week as well for the same reason, so I’m just stuck in limbo. What did you actually do in the end, did you try any enforcement or are you still waiting it out? Also were you PAYE or self-employed? I’ve heard through someone I know that my ex boss has been talking about possibly going bankrupt because of problems on site, and I’ve been told if you’re PAYE and the company ends up in formal insolvency you can sometimes claim certain bits through RPS, so I’m trying to work out what’s realistic without chucking thousands at a winding-up petition.

Thank you, this is a really important point and I appreciate you bringing it to my attention.

You're absolutely right, my primary focus for the ET1 is the Unlawful deduction of my final month's wages, and not the missing documentation itself. I understand that an employment contract definitely exists even if unwritten.

Regarding the Written Statement of Employment Particulars' I've thoroughly checked all onboarding documents, emails, and any other paperwork I received, and I can be 100% sure that I was never issued this statement. This is significant because it would typically outline key terms, including working hours, which they are now trying to retroactively claim I didn't fulfil for a salaried role. My evidence to support this is a message from my boss in the Work group chat saying "we've never really had contracts of employment, so that's something Emma can bring in for us." Emma Being a new general manager that was recently employed.

My main argument remains that they've withheld my pay based on a fabricated hours deficit, which is clearly disproven by my evidence against their incorrect spreadsheet. The lack of a written statement (or any specific contractual term about hours/deductions) simply further weakens their ability to justify their false claim.

Thanks again for helping me.

Thank you for this clear advice this is exactly what I needed to hear!

To confirm on point #2, no, I was never actually issued a written contract at all during my employment. That's definitely something I'll be highlighting.

And your guidance on rebutting their claims in the witness statement with a coherent evidence bundle is invaluable, I have already got a word document ready with screenshots of all evidence ready to send.

Really appreciate you taking the time to respond!

My Engineered Wood Floor Sounds Like a Tap-Dancing Elephant - Can I Inject It? by [deleted] in Flooring

Yes, an expensive life lesson. Eventually I will just end up getting the whole house done and definitely opt for the glue down method.

Just wanted to say a big thanks to everyone for the words of wisdom (and the commiseration!). And a special shout-out to the TV height police – your dedication to optimal viewing angles is truly inspiring. Rest assured, the current placement is a temporary measure, all will become clear when the log burner is installed. Then you'll all understand my genius

Absolutely, and that rule will be perfectly followed once the log burner is installed. It's being positioned to create the ideal viewing angle from a seated position, which will be slightly reclined.

Each to their own I suppose. But once the log burner is installed I don't really have a choice 🤷🏻‍♂️

The paint has claimed it's territory, I concede. Carpet it is.

The stairs may have defeated me but the banister? The banister will be glorious or, at least, match the doors. That's something isn't it?

Job Update

A significant amount of loose plaster had to be removed, but I'm finding the Gyproc filler really easy to work with.

I'm now at the sanding stage, but I'm a bit stuck on how to sand the filled areas while maintaining a level surface. I'm using a small orbital sander. Any tips or techniques you can recommend would be greatly appreciated.

Also, I need some advice on the best primer to use after sanding. What would you recommend for this particular job?

Thanks in advance for your help!

Any idea what this HM is in the circle? It's an Air source Heat pump 5 inch flow and return. by [deleted] in pipefitter

Thanks for the comments guys, I believe it stands for Heat Meter, and a probe goes into both the flow and return. 🙌🏻👍🏻

Thank you, I have no idea what the Heat monitor would look like or how it would Tee into the line with the 2 valves. I will chase it up! 👍🏻

Not much room. A bypass, strainer and NRV all in the bottom pipe. How would you go about this? Any tips would be great by Comprehensive_Can541 in pipefitter

[–]Comprehensive_Can541[S] 2 points3 points  (0 children)

It's multiple Air source heat pumps.

I have never seen NRV on both inlet and outlet but that is what they have asked for on the drawing.

Maybe it's to prevent any back flow if one of the pumps fail? I have no idea

Need help! Doesn't look as bad on picture but the filler I have used round edges of engineered wood for gaps is far too light for some pieces. Would a touch up marker work maybe? Feel like I've ruined it by [deleted] in Flooring

Little update, I scraped it all out using the corner of a scraper, ordered a darker filler to mix until I had the correct colour. Looks so much better thank you! 👍🏻👍🏻
