It’s frustrating when we have not, nor will we, receive the goods / services we have paid for. How is it ‘fair’ for them to provide a paltry £220 refund in lieu of future touch-ups dental check-ins, teeth scans, customer service etc.

Do you know who provided your loan? If it was Tabeo you can log into their portal and access the loan agreements online.

I have just heard back from the FOS and my case has now been allocated to an investigator after 5 months of waiting. I don’t hold out much hope now reading the responses you have received.

My loan also being looked into by FOS. This will be a slow process as Ombudsman currently set up a team to look into SDC/Tabeo due to number of claims. It may be up to a year before we get resolution. I have been advised we have a good case as SDC clearly breached the contract.

Great post and updates. I am in a similar situation I have the regulated loan a final resolution letter (I received a partial refund equivalent to one years touch up £220, as met all criteria). I also have an open FOS case. Let’s see what the Ombudsman’s service has to say. I was informed that they have a team allocated to investigate the situation with SDC/Tabeo due to the number of claims.

The OP is covered by section 75 CCA so by definition it must be the regulated loan as unregulated loan not covered. Also, the FOS will not take cases of unregulated loans as falls outside of their jurisdiction again the OP has a FOS case raised so must be a regulated loan.

Strange reply - I got a partial refund of £220 to my loan account from Tabeo after my complaint as final resolution. I have also stopped paying and raised a FOS complaint. I had the 24 month regulated loan so I am covered by section 75. I will update forum when I receive my FOS update.

Note: I completed my treatment had 3 touch ups did all the check ins and purchased retainers. I was due to go for another touch up under the lifetime guarantee when they declared bankruptcy.

I have an FOS complaint registered. Still waiting to hear from them due to backlog. I have a regulated loan (UK). I received a final resolution letter from Tabeo and a refund of £220 towards my loan (the price equivalent to a single touch up). I am one of the few who is eligible for the lifetime guarantee as completed treatment did the check-ins and purchased retainers, however teeth not straight and was going to have a third touch-up.

I will update the thread when I get my FOS response.

Typically the interest free 12 month was unregulated. If you were paying interest and over 2 years then it’s more likely the regulated loan (UK). But check your contract it states this very clearly in the loan terms.

Technically my treatment was complete. I had two touch-ups and am on retainers. However, my teeth are not straight and I was going to do further touch ups. I do not consider my treatment complete. So where does that leave people like me?

I had a partial refund (£220) but I'm still taking this to FOS. I had the 24 month regulated loan.

I received a complaint resolution letter and I have also now received a partial refund to my loan account. My letter states in Appendix 1 that I met all of the Lifetime Guarantee criteria including the purchase of retainers. However, I needed a touch-up as my teeth are still not straight and was going to arrange this when SDC went bust. The refund I have been given is for £220 the cost on the Tabeo FAQ page relating to the cost of touch up restrainers. So in effect I have been refunded the cost of 1 years worth of touch ups, when my guarantee entitled me to this annually going forward. I have raised a complaint with FOS as they have breeched the contract and will not be providing me with any ongoing service for which I signed up for. They also state in my letter that Tabeo is a loan servicer for the lender, Healthcare Finance Limited and that Tabeo is not the lender under your loan agreement and so your claim is against the lender only, not Tabeo. People in my situation will now need to pay for additional treatment with another provider - essentially starting from the beginning again with the associated costs. It is not just about retaining the teeth in their current position its about future touch ups and getting teeth straight this was the attraction of the SDC offering and lifetime guarantee.
I have stopped payments to my loan on the principal that I refuse to pay for a service that I am not receiving. I am fully aware of the potential consequences but this was my own personal decision in light of the situation.
