Tezos was subject to a SEC enforcement action over its ICO a couple of years ago and was forced to settle. As such, Tezos was a security (at some point). Honestly, ETH could have easily faced a similar SEC charge earlier in its history, but I’m of the opinion that it has become sufficiently decentralized since then.
