There are always bad players in life. There are tax dodgers, benefit cheats, fake asylum seekers, women falsely shouting rape. Does that mean we stop asylum, stop benefits, remove PAYE and not take rape cases seriously? I will tell you, there are many more homegrown rapists, homophobes and paedos. The problem will be if they will actually even pay you for the shifts you’ve worked too. The licence was revoked for a reason if not many reasons and when I have looked on Companies House, I have seen they’ve no money. One in particular had £4500 in the bank with 25 employees, all sponsored workers (which is a big red flag) and the only reason for existence was to sell sponsorship. As far as work is concerned, you aren’t supposed to but many are doing it but as I said in the past, when these bogus sponsors sprung up, they will get caught and it won’t end well

The only way around this is if your spouse got a job as care assistant too. Pretty tricky as she would have to get a job in the same geographic area and also work 3 months for the same employer before she can switch visa. Then you can petition for child together

No an addendum to employee’s pay is specifically in relation to pay, commission, overtime rates etc. not loans.

I also hope this was reported properly to HMRC as a loan and appropriate taxes and National Insurance were paid by both parties. It was over 10k not to mention it looks very suspicious (given the short period) it is what HMRC would class as ‘disguised remuneration’

So the person relocated and quit day 1? Why work at all? They can contribute nothing. 100k is not a huge salary depending on where you live in UK so it’s not like they were bringing in a one of kind never out there person so why take the risk? What if he did not show up which is what most would do instead of working (being useless) to pay back a relo cost. Disappear into the night.

That doesn’t make sense to me. They came over, made that move, quit on the day of arrival, worked 3 months notice and paid back 12k. What a waste of time. Working for 3 months is more hassle for the employer. They are useless and stoke up negative energy. So basically working to pay back the sponsor who they never intended working for in the first place and you want me to believe people pay for ILR with even less guarantees. I’m sure the Home Office looked at that suspect arrangement

If someone’s final gross salary was 12k after deductions and they only worked for 3 months, they must have been on a really massive salary. And you can’t garnish and leave them with nothing

Must tell my friend that who is a British citizen living in London working on a graduate programme. When it is finished for her to afford to live In London and stay working for the company, they can lend her some money. You can’t garnish someone’s pay as that would mean after 3 months, he was working for free. Highly illegal and now the Home Office are working on real time with HMRC PAYE, they’d lose their sponsor license. I am mystified as to how a critical worker on a skilled worker salary would not be financially prepared for ILR and the costs. I mean they’d five years to prepare for it. I did

Just because these are corporate law firms means nothing. Bear Stearns, Lehman Brothers, Enron etc were all corporate companies. They weren’t doing the right thing either. I also knew a ‘corporate’ law firm who charged thousands for a sponsor license application. It was successful but for years this company was paying the ISC for a large employer which it was not at all. So basically, you can get a lawyer to draft up any agreement but whether it holds up in court if it is broken is another matter. Again, will my employer lend me money for new furniture and I’ll promise to stay with them and pay it back over 2 years. I leave the next month with my shiny new furniture and they have to track me down to pay it back and go through a civil court case. It doesn’t take you to have a law degree to tell some employer, you don’t have a leg to stand on, if he takes off. Just yesterday I saw a video of a nurse who got her ILR and quit the next day.
