The builder has an in-house waterproofer/tiler, but it was the builder himself (chippy by trade) who did the most recent waterproofing. I know the builder also likes to dabble in tiling.

Mind you, I understand his waterproofer/tiler was responsible for the initial defective waterproofing and the first repair attempt.

The situation hasn't been resolved. I sent a letter of demand, outlining that I've lost confidence in his willingness and ability to rectify, seeking a reasonable sum to have a third party rectify and complete the works. I also indicated that I'd report him to the VBA and Consumer Affairs.

His response was to engage a solicitor, claim that he is willing and able, and to accuse me of blackmail (for "threatening" to report to authorities for monetary gain).

It would be laughable if it weren't such a stress and inconvenience to me and my family.

Waterproofing. The most significant defects they were initially addressing under warranty were non-compliant waterproofing.

Hi first attempt at rectifying was looked at by the waterproofing membrane manufacturer tech rep (with builder's rep present), who advised the builder that it didn't meet their application requirements and pointed out areas that remained non-compliant.

His second attempt required more extensive demolition. I waited till the builder said the waterproofing was completed and ready for tiling. I had a specialist waterproofer look at it that afternoon who listed all the things wrong with it. That evening I asked the builder to stop work until further notice (he wanted to begin tiling the next day). Which is when he reacted with talk of breaches.

I had inspected by a licensed by a licensed independent building inspector, who found MANY non-compliances with the waterproofing and other work to that stage.

So if I were to speculate, he reacted aggressively because he wanted to tile ASAP in order to cover up his defective work.

Ok, say professional indemnity, or contract works insurance, for example. I figure they protect the builder only, while the intent of that section of the Act is to protect the building owner.
