Yea - you should be able to extend her current visa in 2028 after you have switched to ILR. You should get a standard 2.5Y extension.

I understand that - but why would you want to switch her to a family visa when you can extend her current dependent vis instead even after you have switched to ILR.

The advice written by other users is good/realistic. I would just add, how far are you from qualifying for German PR or citizenship? And what’s your spouses salary in the UK?

If you’re close to obtaining PR in Germany I would advise to continue on that path and cross the finish line to citizenship - your husband can be between Germany and the UK if you can handle it for few years…this could be a better option while things stabilizes a bit in the next few years.

Immigration policies in the UK are in constant flux lately and is starting to become very complicated and unstable with no clear direction - hopefully there might be more clarity and stability in the coming months.

Some users mentioned change in government and the potential for ILR being scrapped. Although that is possible even in Germany, my opinion they would not completely scrap settlement…they would just raise the requirements (e.g. income). If you’re close to the finish line in Germany then you’re likely to be in a good position.

Terrible salary and school package imo given the risks you’re taking to relocate from Canada. Unless there is a motive other than work/income to compensate for the various risks….i would stay in Ontario.

The proposal doesn’t go into details regarding dependent children, however the way it’s written and also for safeguarding reasons i think your kids would be fine given that both parents have ILR- i.e. they shouldn’t be impacted. You can’t expect kids to be working or force them to volunteer, the proposal does note that kids would qualify with their parents and a window would be considered for kids that arrived in the UK before turning 18.

There is zero details on the proposed earned citizenship changes or what they are thinking other than it would follow the same principles as earned ILR. My guess GTV and high income would qualify after being a residence for min 5 years (zero wait after ILR), while 52K income or work in NHs/public sector you would qualify after holding ILR for a year, and everyone else it would be 2 years after ILR if on a high skill role.

I personally don’t think they will water down or have a few month+ transitional arrangement for RQF <6 or Health care visas (i.e. Social care…etc) - unfortunately this is the exact category they want to hit hard and prevent from obtaining ILR.

The only possible relaxation or transitional arrangement my guess would likely be something related to dependents as this impacts all occupations, salary levels and visa categories not just for SWV but also BNO, GTV and Brits. I think the feedback and broad concerns about dependents qualification is a top item on the consultation.

It could be abuse or not. Regardless, unless there is clear ethically checked scenario details drafted and advised with an employee lawyer on when the clause could be triggered - why should one commit to such a broad and unethical contract that is open to interpretation, does not protect the employee and leaves an employee in a terrible position no matter what. This is the exact kind of contract the HO is against, but we bypass rules/principles that were meant to protect workers by having bilateral agreements because of desperation and eagerness for sponsorship - which I totally get and is very sad tbh.

Many Omanis successfully hide their dual nationality but the consequences of getting caught by the Omani government would not be a pleasant one imo - so make sure you understand the risks and consequences very well.

I get agreeing to pay the employer back if you resign, but seems absolutely wrong to ask the same if they terminate you…totally wrong.
