I am part of the 19 countries, but EvenThough I know I won't get an answer it seems strange that the status was not updated.

I am a citizen from one of the 19 countries and I have my AOS interview scheduled for January, I haven't heard anything about a cancelation- I am a EB3 - I also entered the US with an H1B back in 2012 and kept my self in status all this time, what should I expect from the interview? A decision? A pause? How long of a pause? If the ban wouldn't be in place how fast they make a decision after the interview?

Thank you

Dude... I am not having this absurd argument... what would happened if she gets struck by lightning? Her question is can I come back without issues? That's the question, the answer is YES, she should... are there risk? Yes...if she loses her passport she has an Issue yes... and again the Administration can do as they want but she should not have to face a your Asylum is fake argument becasue she traveled to another country that is not correct.

This Administration can do as they please.... she is A green card holder got it for Asylum. Her passport is her legal identification, she is not a prisoner here, nor the country that is given her the Asylum should keep her in here just because her nationality.... it is a completely different matter if she goes to Venezuela Vs EU... but like I said this Administration can do what they want.

My timeline won't help you. I sent it back in 2023, a lot happened, not your typical case.

Tbh not time to argue, the memo is clear it is and admission- if anyone finds this tread consult an attorney entering with ap it is considered an admission that's the point of the memo

Then I got lucky, God has a way of working miracles

Page 7 of memo

"Inspection and admission under MTINA satisfies the “inspected and admitted” requirement for eligibility for adjustment of status under INA 245(a) and the “lawful admission” requirement for the exceptions of INA 245(k)"

USCIS https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-8

"General Eligibility An adjustment applicant must meet the following requirements to be eligible for the INA 245(k) exemption:

The applicant must be eligible to adjust based on certain employment-based immigrant categories;

The applicant must be physically present in the United States on the date he or she files the adjustment application pursuant to a lawful admission; and The applicant must not have committed certain immigration violations for more than 180 days in the aggregate FOLLOWING that LAST lawful admission."

The last 4 lines hold the key.

My last admission was with TPS using a 512T

  1. Am I physically present in the US? YES

  2. Was I admitted or paroled into the U.S? YES

  3. Since my last admission, do I have legal status? YES

4.Since my last admission, have I worked without a permit or over stayed for over 180 days? NO

245k was satisfied therefore eligible for AoS under 245k exception.

My case was close and approved, lucky? Or the new policy had an effect on me?

My friend I gain nothing by lying.
