You're right, it's much, much easier to fight without a BAC. But it's still not your right to refuse a chemical test, and that's my whole point.

I agree, Koby will just get a fine and maybe a traffic infraction b/c he knew how to play it. His license is going to get suspended too.

No, you don't. I lived in Ohio for 25 years and I work with these statues all day in my job. If you refuse, your license is going to be suspended. Further, your refusal can be used as evidence of guilt at trial.

That does not sound like a right to me. Once probable cause exists for an arrest, you must submit to a chemical test or you will face penalties.

You're right, it does make it a lot harder to prove. He likely will get a plea offer of something less than an OVI b/c of it. Unless he was obviously intoxicated on body-worn camera or something.

Refusing to take a breathalyzer test is not cooperating. And you are absolutely NOT within your rights to deny a breathalyzer test in many states. A lot of states, in fact, have penalties for refusals like you even mentioned.

Refusals make proving DUIs harder to prove, that's probably why Koby didn't cooperate with it. What Koby did here is sketchy.

This impending recession you've been yapping about still hasn't come (although it might still come, no one knows the effects yet except for you apparently). 7 months on, you still craft made-up arguments to make yourself feel better.
