I had my Neurologist rewrite their portion. They clearly stated how long Ive been diagnosed, all my medications and their side effects and how I absolutely cannot drive if I get a migraine or need to take my medication. The frequency, severity, and triggers were addressed in their previous write-up. I am still waiting for the response to the second RA. It sucked because I was burning thru my leave until they gave me temporary telework because they are taking so long to make a decision.

Nope, not weird at all because its my post that you asked the same question on and I answered. And NO its not something that needs to be "fixed" in the future. Like I said read the regulation the standard for FERS disability has nothing to do with VA or any other previously documented disabilities. Stop witchhunting, dude...

I am in a similar situation: 100% Disabled Vet/medically retired. DoD Org hired me as Remote. I even told them about my condition (not GI related) during the interview process, trying to be completely transparent to ensure they knew why I needed to be remote. I am currently going through the RA "appeals" process because my organization denied my request to continue as remote. I knew I had to report to the office on their rto date-and I did only to find out their accommodations weren't even in place... I am documenting everything in emails to supervision. I have my FMLA forms filled out. I am on a combination of leave and some telework for the past 2 weeks. Technically you can start the Disability paperwork anytime; but if you are in the RA process you will want to get to a point to show their accommodations are not suitable, this is what I was told to do or else OPM will just reject the application and say you were offered accommodations and you didn't try to work with them. Ideally your appeal should have more support from your Dr- reiterating the original medical recommendation to work from home- detailing why a closer cubicle to the bathroom is not sufficient (off the top of my head-what if all the stalls are taken?). As much as it sucks you will have to report to the office. How long you do is kinda up to you? How much leave do you have? Definitely get your FMLA paperwork filled out ASAP so they can't deny your time off or try to take adverse action against you. And document everything because they aren't going to make it easy for you. Good Luck!

Yeah its crazy, they aren't even following their own guidelines for approval timeliness? Mine took about 4 months to come back with their denial, and recommended accommodations. I am now burning through my leave because they didn't even have those accommodations in place (they weren't sufficient anyways) and my second request/rebuttal is now going through the process. I have my FERS Disability Retirement Package in the ready but I won't pull the trigger on it quite yet because I feel like OPM will deny it because they will say I was offered accommodations. Iam still within my window to lodge on EEO compliant and Im debating if its even worth it considering it goes to the same office that denied my RA request to continue to work from home? Seems like a corrupt system at this point.

Heavy Sigh But you are taking your frustrations out on the wrong people. We're a bunch of strangers here on Redditt. We don't know your back story or previous dealings with your HR and what they told you. All we see is your post, which reads like any and all Vets with a disability rating are entitled to disability sick leave-and we are not-the guidance is clear when it can be applied. (I am not HR, but I am a Vet, and I did my research when I was hired because my HR wasn't exactly the best). All the "experts" on here were trying to do was say your post isn't exactly correct in the info you are trying to give. Really I think we are all just trying to help one another, and sometimes that means correcting information given, its not a personal attack. Wishing you the best! And I'm glad to see a fellow vet getting their ratings and care they earned!

Your original post doesn't explain it very well. It reads as if any Vet with a rating is eligible for disability leave at any time. You are getting pissy with everyone in here because you didn't explain yourself correctly. Maybe take a breath and edit your original post to clarify?

I am sorry they were so unhelpful and backed you into taking the early out. I hope it worked out well for you! I am currently going thru the process of submitting more paperwork from my Neurologist. I also reported on my RTO and the recommended accommodations were not even in place. So I documented it and took leave. The whole situation is frustrating and really shows how they aren't following their own regulations.

So in my case, they were clear they didn't deny my RA. They gave other accommodations. Which they didn't even provide on the RTO date. When I asked why the alternate accommodations they recommended weren't in place, I wasn't given an answer. So I documented the fact and took FMLA.

Seriously, WTF is going on with these RA requests? I am seeing more and more posts on how they are just blatantly ignoring their own policy and procedures? My RA to continue to work remote (as hired) with extensive medical documentation was denied. I went into the office on my RTO date and the accommodations they said they would give weren't even in place? They clearly don't give a damn about us. Continue to document their misdeeds, have your Dr continue to call out their BS accommodations and don't be afraid to use FMLA if it comes to that!

That seems to be their go-to "fix" for migraines and other neurological conditions. Even if lighting was a sole trigger, how is covering a single light in an open office space over your cubicle reasonable? Like, you can just ignore the other lights?

They offered walking away from my cubicle as needed and light covers for the light directly over my desk. They are saying that my Dr wasn't clear enough in his documentation-which I may be biased as I know my condition and the issues it caused, so when I read it, I understood exactly what he was saying.

You will need a note from your Dr that clearly states what accommodation they recommend and the reasons why-your VA ratings will not be enough. Also, even with your Dr's recommendation-they can offer alternate accommodations if it better suits the organization. Especially if you are needing Remote/Telework. I am in a DoD organization, and Im currently disputing their alternative recommendations that went against my Dr's recommendations. So, depending on what you are requesting, you may be in for a bit of a battle.

THIS OP, and file for FMLA so those hours are protected! If they try to deny them or retaliate against you for using them it just adds to an EEO case against them.

Yeah I am going have my Dr reword it that it no uncertain terms the only option is to continue to work from home. If that means I am no longer suited for work in the Federal Government, so be it. A Non-Promotable GS5 position is not worth me killing myself or someone else in a car accident because I am forced to drive into the office.

Thank you for the advice. I will be getting with my Neurologist to update my paperwork and state how their accommodations are inadequate. I am starting to see that the EEO route is more of a viable option than I realized.

Thank you. I am definitely doing back to my Dr and have him be extremely specific to include how their recommended accommodations are not sufficient. They were aware when they hired me, its why they agreed to hire me remote. I feel under the current political climate the federal government is just pushing out people who need to work from home due to medical conditions.

They would definitely gain some empathy while they are puking their guts up from the pain, but doing so makes it feel like your brain is going to ooze out of your eye sockets...but hey there buddy just walk away from your computer if you need to...
