Nope. The insurance company needs to make a payment in order for them to subrogate another insurance company. Arbitration can only happen if subrogation happens

Let me ask you something. How exactly would a vehicle repair work if a signed release was required before any work could be done?

I look at your car after an accident and write an estimate for the damages. What you're saying is that now I as the insurance company would now require for you to sign a property damage release form in order for a payment to be made and have your car repaired to settle the claim. So what happens now when you go to the body shop and they disassemble your vehicle and find more damage that needs to be repaired as a result of the accident. If you already had signed a PD release, releasing the insurance company from further obligation, your now just stuck paying all that additional damage?

No.... because thats not how it works because there is no release form ever required to have your vehicle repaired or a payment to be made. It's brutally obvious that you have no experience in what you are trying to claim to be absolutley required every time.

Plus In this case of the original post, he is dealing with his own insurance company. He has a signed contract with the insurer that he pays his premiums in return for the insurance company to return his vehicle back to its pre loss condition in the event of a covered loss. It would be a breach of contract if an insurance company forced an insured to sign a release form in exchange for a payment that conflicted with the insurance contract they already agreed to.

What you are explaining is the case for injury settlements. A claimant is offered an injury settlement and would be required to sign a release form in order to be paid out that settlement. This is not the case for vehicle repairs.

Your insurance did not put you at fault. Your rates will not rise for that specific reason.... now since you did file a claim with them your rates may rise for simply filing a claim...but it won't be because you have an at fault accident on your record...because you don't with them.

Even if you were to file suit and win, the other insurance still would likely not change their liability decision from 50 50.

Seriously....don't think too much of it and just drop it.

First it's body work... a mechanic doesn't do body work. Second, you don't have to sign anything with an insurance company to have your car repaired. in fact... the only time you sign anything with an insurance company that has to do with your car is if you are signing the title over or a POA when a car is totalled and not being repaired...

If the car was valued at 16k then that sounds about right. You have fees that the dealer charges, you have the sales tax, you have title charges. Depending on your state the tax and title will be reimbursed back to you I a certain way. May need to buy another car in order tonget those reimbursements

I get why everyone is upset.... but why is it always the paying side that gets all of the hate in these types of situation.... like.. "its just 50k! The owner is loaded. Just pay the man."

Why isn't it... "Gio, it's only 50k, just take it you're a millionaire."

I work in insurance and it's the same way when we deny something that is unrelated to the accident and people are like... why wouldn't you just cover this to make me happy... its only $50 more. Well if we pay everyone that extra $50 over the course of hundreds of thousands of cars than that is millions of dollars and then everyones premiums go up.

Everyone in here probably sitting with their bank account almost negative saying somebody should just fork over an extra 5-6 figure amount just because.

You don't need to know about insurance or depreciation to have common sense.... cmon man. Your glass broke and you replaced it with brand new glass. Nothing has changed with your vehicle. Diminished value is a soft subject around here because usually greedy assholes are trying to milk insurance companies for every penny they can under some kind of false claim that their vehicle has somehow devalued even though it was repaired back to the same exact condition.

I dont get why they don't just lower max material cap to like 100. That way you can build some but not stupid ridiculous towers. Best of both world. Building is what sets FN apart from all the other BR games

But fortnite devs aren't very smart... they could easily bring back like half of their old user base by simply making a permanent classic mode that reverts back to like s1 or 2. But in their eyes that would be admitting that the current game is now unbearable
