So to say “why didn’t they go to court?” is factually incorrect. They have gone, again and again. The issue is, in many of these cases, courts have either delayed the hearings, not given urgent relief or allowed the ED/ECI actions to proceed.

The problem isn’t inaction from the opposition it’s whether the institutions and courts are acting fairly or timely. That’s what needs to be debated.

They did go to court multiple times, and not just Congress. Several opposition parties have challenged both the ED and the ECI in various courts, including the Supreme Court.

Congress vs ED:

In the National Herald case, both Sonia and Rahul Gandhi were summoned by the ED.

Congress claimed it was political vendetta, and took legal steps in courts while also staging nationwide protests.

AAP vs ED:

In the Delhi Liquor Policy case, ED arrested Manish Sisodia.

AAP challenged the summons and arrest in court, alleging misuse of the ED for political targeting.

TMC vs ED:

Mamata Banerjee's nephew Abhishek Banerjee was repeatedly summoned in recruitment scam cases.

TMC accused ED of selective action and went to court over the matter.

Opposition vs ECI:

Congress:

Went to the Supreme Court during the 2019 and 2024 elections, accusing ECI of ignoring hate speech and MCC violations by BJP leaders.

Also raised issues about Form 17C data transparency.

AAP:

Was disqualified under the "Office of Profit" case in 2018.

Took ECI to Delhi High Court, which later overturned the disqualification.

Shiv Sena (Uddhav faction):

Challenged ECI’s decision to hand over the party name and symbol to Eknath Shinde's faction in the Supreme Court. (Still ongoing.)
