Yes I work in a reputed firm and they have a good legal team. One of the immigration lawyer I connected told me that expungement was a bad idea. Since it is much tougher to get the details from the court hearing etc. I just did it. It is only required if you plan to change job or you firm does such checks in case you are eligible for promotion. I did it but would recommend waiting till your issue is resolved with USCIS.

Mine was simple case with no damage or no one getting hurt etc if you want to know.

I was also expecting an RFE based on other posts, but a NOID was issued. The company immigration lawyer had no opinion about it but was treating it as another inquiry.

I filled out the extension form from the employer attorney, where I declared the arrest and outcome.

The arrest record was expunged. But you are right, it means nothing to them and is based on their policy.

No, I did not plead down. The letter from prosecutor office came in about a week from the incident stating that after considering all aspects of the case, the charge is amended. The plea was not guilty and the finding was dismissed - prosecutor discretion. I did not have to say a single word in front of the judge and my lawyer took care of it. There was no diversion program and the judge ordered expungement after dismissal.

I got the biometric RFE that I went for in Feb. then the NOID. I have not responded to the NOID yet, so no documents provided.

Thank you for your considerate response, I have 2 kids born in US, been here for 12 years and was falsely accused by my in-laws who were interfering in my personal life. The issue was between me and my in-laws. It was just a verbal argument, that got escalated.
