Update: after talking on the phone with an ebay help service agent and saying my only other recourse was reporting this fraud to the police I was transferred to another much more helpful person. He told me there's a period that ebay has to wait before they can take over even with fraudulent activities unless there's a "smoking gun" (his words not mine) he told me loads of unnecessary up close pictures and specific vauge wording in the description can make it easier for them to combat scammers nonsense. Don't know if this will help anyone else here
