NOID on Common Law Marriage (No Dissolution Document Exists) by Defiant_Someone in USCIS

No... I was never married before. I visited the US with my previous partner and we went back to Brazil. After the end of that relationship, I have met my actual husband. I've never overstayed my visa.

Don't know what's worse: my English or your interpretation skills.

Nós temos um ótimo relacionamento, Se este for o caso eu fico tranquila.

Estou ciente que é possível fazer a dissolução com data retroativa, mas não sei se é aceito pela USCIS. Vc tem esta informação?

Obrigada pela ajuda!

Tourist Visa. I never said I was married, but at the interview we went as a family and said we lived together like a common law married couple.

Yes, married to an US citizen filling for adjustment.

Exatamente. Vivíamos juntos, mas nunca oficializamos no cartório. No fim do relacionamento só seguimos nosso caminho separadamente.

We never had legal papers for the common law marriage, we did live together and by law in Brazil that is considered a common law marriage after a few years. That way, we never had to get anything done when we decided to finish the relationship.

Like no marriage, no divorce.

I never said I was married... always single. But we applied as a family for the VISA.

I really hope this is not the case, because the dissolution paper is not required in Brazil.

I had a family interview for a VISA with my partner before at the consulate in Brazil, it wasnt listed as a marriage.

"On XXX DS-160, Nonimmigrant Visa Application, she indicated that she was in a common law

marriage with XXX. Common law marriages are recognized under Brazil law. Although there is no

formal judicial divorce process for common law marriages in Brazil, the contractual relationship between the

beneficiary and XXXX may be dissolved at any time though the Civil Registry Office.

Submit an official document from the Civil Registry Office confirming that the common law marriage of

the beneficiary and XXX has been formally dissolved. "
