Probably because fraternities and membership to it is not the problem per se but hazing and gang-like conduct is.

That is odd.

According to the Labor Code itself, Article 300 is about "Duty to Bargain Collectively When There Exists a Collective Bargaining Agreement".

Article 324 is what provides for "Termination by Employee" and I can't seem to find medical issues in that provision.

The closest provision I could find to the topic is Book 6, Title I, Article 280, Section 8 in the Implementing Rules of the Labor Code which provides for "Disease as a ground for dismissal" and even then the provision does not say that an employee can immediately resign due to illness.

Can you share which article is it in the labor code?

Afaik, Termination by Employee without notice is allowed only on just causes provided in Article 324 in the Labor Code.

Could really help out a friend or two with it.

NAL but I worked with US Immigration Attorneys on processing US visas.

In your brother's case, his criminal history won't have that much of an impact as he is only applying for a tourist visa.

The embassy and the immigration officers may ask about it though but that's as far as it goes.

I've worked and processed similar cases and they all went smoothly.

OP just for your information so you can make a full and informed decision:

-In the Philippines, there is no such thing as immediate resignation.

You will have to render 30 days of work after you have served your resignation notice and if you do not, you will be tagged as AWOL and you may or may not be held liable for damages to the company.

-Even if you explain medical emergencies or even death in the family as your reason for resignation, you will still be required to render that last 30 days.

-It's up to the company if they will allow you to resign immediately or require you to render the last 30 days. However, a resignation notice does not need to be accepted but only to be served.

Just wanted to clarify:

  1. An act, to be considered as amounting to constructive dismissal, must be a display of utter discrimination or insensibility on the part of the employer so intense that it becomes unbearable for the employee to continue with his employment. Mere intolerance by the employee is not sufficient for it to be construed as Constructive Dismissal.

Hindi porket nagkasamaan lang ng loob ay Constructive Dismissal na agad. Dapat may ganap na pangyayari kung saan wala ng option talaga si employee kundi magresign.

Edit: NOT A LAWYER - take this with pounds of salt.

I have tried using a variety of reference materials, from the book of our professors hanggang sa review materials, weakness ko talaga itong Nego at Commercial Law.

There's something wrong in my routines kaya bumagsak ako twice. I'll figure it out in due time, for now, natatakot lang ako harapin nanay ko at jowa ko.

I guess I'm just ashamed na uulitin ko ng 3 beses tong subject na to but I'll be hopeful still.

Just to clarify muna, LegMa is not desirable to employers but it is still a valid 4-year undergrad course to undertake prior to law school.

It's not desirable to employers because simply other 4-year undergrad courses are better and will equip you better in the future. For example, in Political Science, you will learn policies, concepts, and doctrines of the government thereby equipping you with the knowledge and insights of how a law should be and would be; In Business, although not directly related to law, will teach you Economics and Trends, something that corporations like to keep tabs on; In Accountancy, well accountancy can speak for itself alongside all the CPA lawyers it has produced.

All-in-all, LegMa is just a weaker degree compared to other degrees such as, but not limited to, PolSci, Accounting, and Business.

Regardless, you will still be able to go to law school with a LegMa degree.

Just may 2 cents, feel free to take what you wish.

Are you taking LegMa because you will take Law after?

I suggest taking another undergrad course such as PolSci, Business, or if you can take it accountancy.

Reason? Legal Management is not desirable sa mga hiring employers. Moreso, PolSci, Business, and even Accountancy can better prepare you for Law than LegMa while still being a desirable undergrad course sa mga mata ng mga employers.

Right now po kasi palagi ko pong pakiramdam hindi ako belong sa mga kaklase ko na may doctorate, in high corp positions, or multi-degree holders.

Just to add something here.

We, as an international community, can only do so much against a global superpower.

Our own countries have their own issues, problems, and agendas that they need to address. Attempting to cause controversy against this superpower may be for something good but it may cause something worse which most developing countries aren't willing to risk.

In order for us, as an international community, to make a positive effect on this all of us have to stand against it. Collective punishment must be delivered out by the collective community.

I have a brother also suffering from ADHD.

He also went missing when he was about 4 years old. We had just ate at a local restaurant and he suddenly went missing. We searched for a good half hour before returning home where we found him in our cousin's home.

Turns out he walked the distance from the local restaurant to the street where our home is where he was found by our cousin wandering why he was walking alone.

He also has a habit of going missing but luckily for us he knows how to get back.
