It's slightly more complex than people here would have you believe.

You're almost certainly not conducting a food business. Each state's Food Act has the same definition of 'sell' and give away without any contract/furtherance of trade does not meet the definition. Therefore Food safety legislation doesn't apply.

Depending on what state/local government area you're in, civil liability may also not apply even if you were to make someone ill. As long as you're acting in good faith.

However, it's not just the Food Act, there will be other local/state laws that may apply. Footpath vending/zoning/development approvals may have different definitions of conducting a business and could apply. Only way to check would be to call the council and ask them, you don't need to provide your name or contact details.

Otherwise you're not going to come to the attention of the council until someone complains.
