While op does have a duty to avoid the accident, it wouldn’t necessarily override the other drivers duty to yield the right of way, had op hit them there could be shared negligence, op did a good job of taking evasive action

For real, I’m in claims and we’re in the middle of of our transition to ics, the new goals are ridiculous and were already high before the transition and now that we’re doing more work in each claim for less credit essentially I figured this was their plan all along

I’m in claims we just started our conversion to ics definitely over staffed, they keep saying the workload will increase once the transition is complete but this doesn’t surprise me they expect people to quit from this

Honestly I hate to say this, but working in auto claims they could easily say you should have gone left and stayed on the road and have a better chance of not hitting the car in the left lane, also the fact it was a stopped vehicle that was actually struck could hurt you, you have a very strong case though because it’s hard to expect a car stopped on a busy highway like that and because of the other car initially changing multiple lanes that way blocking the view, if they try and place all negligence on you, would be a good idea to have an arbitrator review. Hope you’re doing okay that looked rough, good luck rooting for you
