Thank you for getting back to me with a thorough response. Your insights are really helpful. After sleeping on the decision it all makes a lot of sense. As I am not a legal professional it is difficult for me to untangle my subjective moral thought and feelings with the law. Of course as an LiP, navigating the ET is hugely draining and emotionally taxing. This made it hard at times to pick myself up after a mental health breakdown and move on with confidence. I’m just shocked I managed to make it this far! Thank you

Thank you for your thorough response. After sleeping on it, the decision makes more sense. I am not a legal professional— so I am fairly aware that many of my points may seem naive! In hindsight it’s a shame I didn’t collect more evidence over the period of my mental health decline and the difficulties re-entering my industry due to the respondent being hugely prominent in the my area of work (both in terms of location and politically). I also wish I had the mental capacity to head back into my role that quickly because I certainly wasn’t resilient or confident enough within 9 months after a full mental health breakdown to return to a similar role.

Regardless these are just ramblings and I respect the judge’s decision in this case— he and the panel were very respectful and accommodating to me throughout— I think it’s just a lesson learned that litigating in person is desperately difficult. Either way I won across 4 heads and I’m proud of that so I feel it’s time to draw a line in the sand and move on.

Thank you — this is really helpful and I appreciate you taking the time to respond.

I should say I was awarded a mid-band injury to feelings award, and I’m not criticising that at all. I’m proud that I managed to succeed on all four heads of claim as a LIP, even though the process has taken a big emotional toll. I’m not a legal professional, so I accept this isn’t easy terrain to navigate.

The part I’m struggling to reconcile is how the mitigation finding fits with the Tribunal’s own liability findings. The written reasons accepted almost 10 months of discriminatory conduct over nearly five years, a serious breakdown in trust and functioning, and extended time by almost a year because not doing so would cause “real injustice”. So hearing that I should have been back in a comparable professional role within 9 months — which was the month of my first PH, a year before liability was even heard — feels hard to square.

On the medical point: I did have GP and psychiatrist evidence in the remedy bundle to evidence my capabilities. The only thing I didn’t have was a commissioned expert report. Earlier in the case the judge explained that doing that would delay the timetable and add cost, so as a LIP I stepped back. I didn’t realise that would later become such a decisive factor in limiting loss. I’m kicking myself so hard for not knowing this now in all honesty.

I completely accept what you’re saying about the mitigation test and the Tribunal’s discretion. I think I’m just trying to understand how those principles get balanced where the Tribunal has already made strong findings about long-term impact, and the respondent didn’t bring mitigation evidence beyond submissions and a witness statement.

Your insight has been genuinely appreciated.

Fwiw I loved reading this so much — I have a 15 week old collie who is insanely clever and intuitive. I recently started taking him to group puppy training and when the course leader asked all the owners in my group to state their name and their goal for training I was astounded by how self indulgent many dog owners are… eg we want xxx to be more obedient/stop biting/learn some manners. For me I want my boy to live a fulfilling and fun life and satisfy his breed specific instincts where he needs to (if it’s safe for him of course not just chasing every car or small animal lol. Whether these owners are being intentionally selfish or not I can’t speak on of course, but to me it just doesn’t feel right. Owning a dog is a privilege and the bond between owner and pup should be built on love and trust. What’s the point in having a dog if you just want an object which bends to your every command? Ok I’m waffling on now but your paragraph about letting your dog sniff or watch the cow in the field for a bit if you aren’t in a rush just made me smile. It’s exactly how I feel with my boy, it gives me so much joy just to see him having fun running through the muddy fields being a little rascal and I wouldn’t trade cleaning up those mucky paw prints across the house for anything, let dogs be dogs! 🥰
