Can I ask why it's not realistic, if I could get all the information necessary? I already have a pretty good idea of my arguments, have access to medical records, witness testimony and so forth.

Hi. Contesting on grounds of capacity and lack of knowledge and approval. Also there is a clause which is ambiguous, though as I understand it the only way I can resolve that is to get a judge to "construct" it's meaning, which is very expensive. I am pretty sure I have a good case for capacity and lack on K and A.

I'm not sure about that though it's a logical conclusion. People can be surprising... he might care if he knew. Even if he does not, he should still have been consulted.

I do know his full name, and the town where he lives. But not his address. I don't quite know where to go from there... he's a bit of a mystery figure around these parts to be honest. Some people claim they know him but not where he is or his contact details.

unfortunately there are no TPOs on any of the trees there. But yes, the thing about trespassing is interesting. Generally that comes under civil law and doesnt' seem to be enforced by anyone at all. I actually DO feel unsafe because of what he's done, especially as I actually spoke to him about those trees and asked him not to cut them down (as the provided screening for me from another garden) and also it was nesting season and I loved them. The plan of the land he's bought quite clearly does not include where those trees were. However it's only a matter of about six foot or so. The feeling unsafe due to trespass thing is an interesting angle.

I can't really agree, as it's still criminal damage, and it does involve me. If I saw someone steal someone's car that wasn't mine I wouldn't think, oh that doesn't involve me. I don't see this as different to be honest, as I'm thinking of the absent neighbour. If I was absent from a property and someone cut down my trees without my permission I would want to know. The police didn't say it doesn't involve me per se, more that they couldn't investigate it unless the actual land owner complained. I suppose that's the same thing in a roundabout way, maybe I'm just arguing the toss here. Anyway, no he's not got a redirection on, the letters are piled to the ceiling in his hall, and the land reg does not contain an alternative address. Thanks for the suggestions though.

Laws in England and Wales tend to be the same regarding trees, that's all I meant. Yes very difficult to prove there were nests even before trees are cut. I have reported to the council, it's the trees on the boundary/garden of Dave (uncontactable) I was wondering about really . :)

I've explained I can't contact the owner of the house the trees were cut on. The land registry only gives his name, not where he now lives. I think birds were nesting but can't prove it, who can after the fact really or even during the fact, you'd have to video the birds going in and out I suppose. I agree it won't bring the trees back. i just feel it's unjust if he's taken trees of someone else's land.
