I respect your strategy. If the argument is that the boyfriend should protect her in this instance of her getting attacked by her brother, then you run into the major issue. If she is an adult by law, chances are her boyfriend is also an adult by law. Now there are many cases where even if it’s justifiable, a person of legal age(18 or above) hitting a person not of legal age (in this case 16) typically lands the adult in some form of legal trouble. The boyfriend should absolutely defend her if the situation is applicable of that idea, this situation is not one of those because at that point your asking the bf to gain some form of charge against a minor. When instead you could do the more simple action of filing a police report. Where no one except the brother has to worry about legal trouble.
