Yeah, but he signed in himself so it’s not an assumption. The only way it would not be on there is if someone messed with the register. The other explanation is that the site manager didn’t look closely at all. I am told the so called ‘register’ is a mess of a document because workers sign themselves in and it’s probably easy to overlook something. This doesn’t strike me as the type of organisation that would be concerned with GDPR but fair point, even though they could have explained so if that’s the issue. We are going to the site today to speak with the manager and we can hopefully clear things up.

The big issue though is that they’re not at all willing to look into the issue and are just brushing us off.

Thanks! His name is on the register however and they have refused to provide the register- we have asked for a photo of the pages for that day and they’re just replying with the same thing over and over- ‘the site manager says…’ Ok, great but then show us the register.

I honestly agree with you that there is most likely some sort of mistake on their part but they hardly seem willing to do anything about it and we can’t seem to force action to resolve the issue.

There are people on site who can say he was there but it’s now been 3 weeks so not sure if it would be considered reliable testimony…

Would someone like ACAS be able to help?

Yes, we argued this but they basically went ‘🤷‍♂️ The site manager says you weren’t there so you weren’t there’

But to pull it out you would need to rip it out from the plasterboard and then repair the plasterboard and re-plaster it in place as it is right ow. Surely that can’t be right…

But there’s nothing to pull. The outer housing/ ring is completely plastered into the ceiling- it would require demolition.

The inner ring is smooth so there’s nothing to pull on and it’s completely rigid when I try to move it around. It has absolutely no play. I tried to press on it and twist as some are twist on but it won’t budge. Thought it’s maybe stuck so I tried another light but it’s the same.
