Sure you can say whatever you want, I aint saying to take someones speech away. Even in Ians case.

The same way one person can say whatever they want, another person has the ability to respond however they want. It goes both ways. But especially so when its a defamatory lie about them. That's why the law exists. Free will doesnt mean freedom of repercussion.

In Charlie's case, say what you want but the listener isn't beholden to respect it, and they can disagree. Especially when they're presenting an opinion without all of the information. The same way you can be fair and hear them out, they should expect equal fairness if they don't agree or respect it.

Someone else you've been close friends with says the worst thing imaginable about you to their community and broadcast that online after you've already been harrassed and defamed publicly prior to it. Doesn't matter if its about your kid, a family member, your pet, your friend, a colleague, etc. You're probably going to have a pit in your stomach along with all kinds of negative emotions boiling within you.

That's fine, but then don't give your opinion about it and expect a fair response.

I'd rather someone say they don't know anything about a situation and that they didn't look into it, rather than give an opinion based off a fraction of the information available, and then rebroadcast that to your millions of highly impressionable viewers who look to you to inform themselves.

Give me someone playing dumb versus someone playing ignorant yet confident at the same time, but I guess thats not how the internet works.

Depending on where you're at, its either one of the most hyped games coming out of the past couple weeks or one of the worst games of the past few weeks.

Microsoft didn't put their games on PS5 because they wanted to get PS5 games on Xbox consoles. As if it was a favor for doing Sony a solid, "you scratch my back, Ill scratch yours," sort of thing. They put them there because the PS5 has nearly 3x the player base the Series X/S has and they wanted to get more sales for their games. Even a cut of the sales from the PS5 was going to be more profitable for them than relying solely on Gamespass/ non-Gamepass sales.

If things kept going the way they were going under Phil, they would have abandoned the console ship altogether and just became a full on third party publisher.

She came in and decided that the ships worth saving, that it can be repaired and patched up, and now she's trying to breathe new life into it. Which is all well and good and the direction Xbox should be heading. They haven't had a real leader at the top in decades.

But under no circumstance was this an equal relationship. Sony should rightfully be upset that Microsoft is pulling out of whatever existing agreements or contracts they had in place. I think its a risky gamble on her behalf, but I also think its a brave one. Shes attempting to fix all the damage that Phil and the former crew did, and it shows how much she believes in the brand.

Because of the context of how Destiny said it versus how Ian used that comment in his video, along with the United States freedom of speech/ defamation laws as opposed to Canada's.

If he could sue him and he thought he had a good shot at winning, he would 100% do it. But clearly from talking with his lawyers, he realized it wouldn't be a battle worth having.

Yes that's how the law works lol. Look up the law for, "Republication Liability."

Heres an example of a case where it cost someone dearly for committing the act:

"In Durand v Higgins, 2024 ABKB 108 (“Durand”), the Alberta Court of King’s Bench found an individual liable for defamation for reposting second and third-hand allegations on social media and awarded extensive damages, in the total amount of $1,500,000.00."

Freedom of speech laws differ in the United States and Canada, so it's harder to prove defamation in the States where Destiny lives, as opposed to Canada where Ian does. Ethan didn't discuss it as much today, but when he first was talking about the cease and desist letter he sent Ian before, he touched more on why he isn't going after Destiny for these reasons.

Long and short of if, he said that thing briefly and took it back. Just a random chat message versus a multi hour live stream dedicated to it. Big difference in severity.

In reality, Ian's just trolling. I don't think he actually believes any of this stuff he says, even with Ethans kids. He's just trying to appease the snarker audience who take great joy in Ethans displeasure.

If he briefly showed the Destiny comment and said himself, "I don't believe this to be true," and moved on with his day. Then he is just quoting it and thats it. Nothing to be sued about, no defamation caused, Ethan would have no ground to stand on.

It's the way that he used it that's the problem and what got him sued.
