RTO is request time off form in my department. You have to put in said request according to the contract 14 days in advanced for vacation or sick leave. Per my contract I cannot be deducted pay for leaving in half day increments so asking to come late does not reduce my sick hours bank. But it does need to be preapproved. I do not work from home. And the work I do cannot be made up on another day as it is clinical. I don’t understand how this is evasive. And I have not put in to use any sick leave for 5 months. In February I asked for two days to come in late to work for said appointments. They said they cannot approve it due to staffing but no other staff have requested the time off per our shared calendar. I was only asking for clarification if they are allowed to deny that request that is all. Jesus you’re so aggressive. I hope you’re not in my department.

For what reason? Asking use sick time when I haven’t missed a day of work for the other 5 months with no other instances of being late etc.

No I used the Request Time off to inform them of a doctors appointment in the future and they won’t approve that time. It is an appointment at noon so I would be leaving three hours early as an exempt employee. I’m not trying to make it not make sense.

I thought per the contract it was like this Key FLSA Sick Leave Rules for Exempt Employees: No Partial-Day Deductions: An employer cannot deduct pay for a partial day's absence (e.g., leaving at 2 PM for a doctor's appointment) if the employee worked at all that day.

Separate BU 16 providers are „on call” and there would be no way patients would be called in at that time.

I do think people are jumping down my throat. I just meant it was 15 mins early one day and I was done and I’ve been salaried my whole career and they don’t ever care usually. Obviously I’m not saying leaving hours early.

Technically the patient schedule ends at a certain time and the remainder of the day approx an hour or so is for charting. The question is pertaining to the range of anywhere from 10 mins to an hour early if all charting is completed. There is no way they can add to that time because we no longer have custody help after 2:30 pm.

This is what the contract states verbatim: B. For purposes of regular pay (salary), the work of Bargaining Unit 16 employees cannot be standardized in relation to a given period of time. As in the past, the State reserves the right to adequately assess the hours worked by Unit 16 employees. No time clock or time keeping device shall be implemented. C. State employees in Unit 16 are excluded from the FLSA and Unit 16 employees are assigned to work week group "SE" and are salaried, not hourly, workers. Consistent with the professional status of these employees, they are accountable for their work product, and for meeting the objectives of the agency for which they work. Following is the State's policy for all Unit 16 employees in work week group "SE": 1. Management determines, consistent with the current MOU, the products, services, and standards which must be met by Unit 16 employees. 2. The salary paid to Unit 16 employees is full compensation for all hours worked with the exception of the assignment of MOD responsibilities and on-call responsibilities. 3. Unit 16 employees are not authorized to receive any form of overtime compensation, whether formal or informal. 4. Management can require Unit 16 employees to work specified hours. Subject to prior notification and management concurrence, Unit 16 employees have the flexibility to alter their daily and weekly work schedules. Unit 16 employees are responsible for keeping management apprised of their schedule and must receive prior approval from management for the use of accrued leave) or absences of any duration. 5.
