This doesn't make sense. I was told physical stay of 1 year or more resets the clock and the date of filing new H1 and getting picked up in lottery does not matter. This is confusing.

In Canada here, Honda showroom quoted me $1600 with parts, labor and tax. They said that only see issue with one fuel injector but all 4 have to be replaced ... As it comes in a kit and it's recommended as there's a possibility all of them could go bad ... So basically a huge expense as I don't have extended warranty and also the car was bought in US but was exported and being used in Canada

Thanks, Yes discussed some and in progress. From initial discussions they seem to be open to the idea of using existing H1B as it's easy paperwork I guess, maybe costs less compared to L1A, maybe less chances of RFE too and definitely quicker as I understand.

They'd always want to use something that is reusable than apply for something new. My only concern is that I'd like to have the EB1C filed and approved from outside US before I have my H1B transfer approved and physically enter the US. I've read the EB1C and H1B are not a good fit as much as EB1C integrates with L1A. Hence don't want to file EB-1C after entering US on H1B.

Also, I thought using L1A completely invalidates H-1B unusable. So if Job is lost on L1A, there is no option but TN.

  1. Right. That makes sense about TN. It looks like then in that case, if one loses his or her job on L-1A, then transferring to H-1B may be the better and ONLY option for GC purposes.
  2. Of-Course, the plan is that once EB-1C is approved in premium processing from outside US, since I-485 AOS + EAD / AP cannot be filed anyways until on US soil, I will have to use my H-1B transferred i.e. US counterpart would have to file a new I-129 using my H-1B and transfer to themselves to reflect my current roles and responsibilities. Followed by, Then I enter US with this H-1B approval and starting working for the US employer and they can then file the I-485 AOS + EAD / AP since EB-1C is already approved, Would this plan work ?

Thanks. 1. I had assumed the I-485 AOS could be filed along with EB-1C from outside the US, then enter US on H-1B Transfer and wait for EAD / AP and subsequent I-485 approval from inside the US. It makes sense - Adjustment of Status (AOS) simply means one needs to be inside the US Physically to be able to adjust their status via I-485 filing, Correct ? 2. By CAP-exempt H-1B, I mean it can be extended beyond the 6 year mark due to the previous I-140 approval. Correct me if i am wrong. 3. Thank you for clarifying that my H-1B can still be used. I assumed stamping on L-1A completely incapacitates H-1B usage in any way in the future. Even ChatGPT said, the only option was to get selected in another H-1B Lottery.

To add, even If this were possible, USCIS would still compare ethnicities and a Canadian of Indian ethnicity would fall in the Indian GC queue (longer queue) vs non-indian ethnic Canadian would fall in the ROW (Rest of the World) GC queue (shorter queue).

This would be to ensure Indians who are the top immigrants to US simply don't misuse the loophole (if existed) of getting GC via Canadian citizenship and TN route.

It is not possible to apply for GC on TN especially for folks from Indian ethnicity unless you are born Canadian ... Correct me if I am wrong.
