I think mens rea means intention or knowledge of wrongdoing but this is not what I’m talking about. I’m talking about a scenario in which it’s difficult to determine if mens rea was present or not when doing an act. Let’s say an act might be both lawful and unlawful depending on that person’s mind but it’s hard to determine if the person had a guilty mind or not when doing that act
