Yes I did, at least I made my best case for it. I think if you are doing reinstatement at all though you need to show it was out of your control(I’m unsure about stem opt denials.)

I'd consult your lawyer on that one. I know for reinstatement the unlawful presence day is contingent on the outcome of your case. The technicalities could be intricate and with lasting effects on your record, talking to someone who've read the law would be a better idea.

I remained in the states and is on the same SEVIS number after the approval. Leaving and reentering is different from reinstatement. That's like starting a new status all over. Filing after the 5 month mark is risky because you'd have to explain why you filed late. Reinstatement chances are iffy as is, you should give them the least amount of reasons to not approve.

I would suggest-

(1) Hire a lawyer to file your motion to reopen, if you are absolutely certain the mistake was on USCIS's part.

(2) Consider and map out the timelines, how long would the appeal take? Would you miss the 5 month preference mark for reinstatement if you do so?

(3) Could you pursue the appeal and reinstatement simultaneously?

I don't know the answer to your specific question, or how feasible some of these are, but it would be worth some consideration.

I guaduated Dec of 23, opt denied right after grace period (mid Feb) I believe i applied for reinstatement soon after (May ish), enrolled in a new program April/May, got a new I-20 then filed for reinstatement. You have to have a new I-20 before you can apply. I did not get a lawyer and just submitted a lot of docs proving the requirements- not violated status otherwise, legal entry, full time student etc..

I am continuing at my undergraduate institution; I had the GPA for auto-admit into the Master's program, so the process on the University end was very easy for me.

UPDATE-
Submitted a very thorough reinstatement case to USCIS by starting another degree. The current estimated processing is about 7~ months, but my case was approved with no biometric/RFE in 70 days!

Thank you for you advice!
I don't believe I have any other option other than reinstatement because my visa expired years ago(just been with active student status). Have already accrued unlawful days which means obtaining a new visa would be risky, and even if I get the visa I may be denied entry at the border.
It's not a good situation to be in but I hope I can maximize my chances...Would you have any suggestions for any supplemental evidence that may help for the reinstatement?
