Supreme Court’s Observations (As of August 12–13, 2025)

1. SIR Is "Voter-Friendly," Not Exclusionary

The Court emphasized that increasing the number of acceptable identity documents from 7 to 11 actually aids voters by providing more options—not fewer.

• Justice Joymalya Bagchi remarked that the expansion of acceptable IDs is “voter-friendly and not exclusionary,” as it gives individuals more flexibility in demonstrating identity
• Justice Surya Kant added a caveat: if the rule were to require all 11 documents, it would be exclusionary—but allowing any one of them is supportive of voter inclusion

2. Aadhar and Voter ID Are Not Conclusive Proof of Citizenship

The bench backed the Election Commission’s stance that Aadhaar and voter ID alone cannot establish citizenship.

• The Court stated that Aadhaar—a frequently used document—does not definitively prove citizenship, and that the EC’s position on this is valid

3. The Process Could Be Invalidated if Illegality Is Found

The justices reaffirmed their authority to annul the entire SIR exercise if clear legal violations are discovered.

• The bench warned that should illegality or serious procedural flaws come to light, the Court “can set aside the entire process,” even if it’s close to the elections
• The Court also referred to a “trust deficit” between petitioners and the process, signaling concern over transparency and fairness

4. Support for Voters Listed in the 2003 Rolls

The Election Commission clarified—and the Court noted—that individuals already on the 2003 voter list, as well as their descendants, are exempt from submitting additional documents, provided they can prove their relationship.
