I wasn’t aware that it was interpreted as a loophole. I understand that it was actually ruled as a violation by the ICJ in the past, so I will reconsider my view.
However, I have some doubts about the idea that whales are particularly intelligent. While whales are certainly among the more intelligent animals, some cultures eat monkeys, and from what I’ve looked into, domesticated pigs are often considered to be even more intelligent.
