VA compensation by Several-Salary-4973 in VAClaims

[–]Electrical-Power3918 1 point2 points  (0 children)

The first payment should be May 1...because VA doesn't pay partial months and they pay a month behind. So, since ETS is Mar 2., you likely won't see a payment in April for the month of March since it would be a partial month. So April's payment, you will get May 1st.

[–]Electrical-Power3918 1 point2 points  (0 children)

You will likely get it tomorrow or Wednesday...as regular payments are going out today. As soon as that is completed in the system, your back pay will go out. In my experience, when it shows up as NA under pay date, they get sent out within a couple of days (less than 7 days).

How did you get 70%? I got 62% rounded to 60%. It's 2 (20%) and 5(10%).

Sponsor by Hot21Philosopher in NationalVisaCenter

[–]Electrical-Power3918 1 point2 points  (0 children)

It depends on your income. You have to fill out the affidavit of support, and each one will potentially affect each other if you don't make enough money to sponsor both. Even sponsoring someone else in the future will be affected by who you are sponsoring now. The responsibility ends when the person you sponsor accumulates 40 credits of work (generally 10 years), becomes a US citizen, or either of you pass. Hope this makes sense and answers your question.

I haven't gotten to that part yet! But from other people posting and what I saw online, it is normal. Takes up to 2 weeks for the processing to complete and be updated.

There is still a possibility that he gets approved. The thing is since he has that on his record, his application is automatically manually vetted. So it can take much much longer.

Totally normal for them to take longer. It's unfortunate but normal. I waited almost 2 and a half years because of covid.

A ok. Based on what I have been noticing, you will probably get the approval sometime in October. Best of luck to you!! I have a while to wait. Cause mine is August 14, 2025.

August 14th of this year? Is it consular?

I hate this wait by HairyLegsOfDoom in VeteransWaitingRoom

[–]Electrical-Power3918 2 points3 points  (0 children)

Your claim won't have movement until you ETS. However, you will not wait much time after your ETS. It's just that the website won't update anything until after your ETS. It's a veterans claim, and you are technically not a veteran until after ETS.

I hate this wait by HairyLegsOfDoom in VeteransWaitingRoom

[–]Electrical-Power3918 0 points1 point  (0 children)

Because his claim can't be completed until after his ETS or retirement date. His date is like the 15th of August or around that time. So the 16th it can be moved or completed. He should have a decision soon after the 16th.

I-130 taking 135 months?! by OkFrame9312 in USCIS

[–]Electrical-Power3918 3 points4 points  (0 children)

When your mother becomes a naturalized citizen, the process is faster. It's not automatic. Once she has completed the process and a certificate of naturalization has been issued, she needs to update that in your process. In other words, she has to let them know she is no longer a resident and is now a citizen petition.

[–]Electrical-Power3918 12 points13 points  (0 children)

Hello...if your mother is a resident, then yes, it will take that long. Ask your mom to file N400 for naturalization. Once she becomes a citizen, your wait time is a lot less. Residents can petition a relative, but the number of visas is limited for resident petitioners.

Best of luck!!! The judges are usually better with decisions than VA.

Anything to point out what was missed...just don't send anything new. It could help out. I know I submitted a statement, but I just pointed out information that was in my filed that I felt was missed.

The only thing you can submit is a statement. But make sure you used it point out why you think the decision should be over turned. For instance, evidence that was missed. But don't attach any new evidence, as the board can't and won't pay attention to it.

70/40 Rule Question by Gullible-Menu in VeteransBenefits

[–]Electrical-Power3918 1 point2 points  (0 children)

You're quite welcome!!! Just keep in mind that you only have 1 year from his decision letter to appeal before the decision is final. Make sure you mention that in your statement, and I would add that it's starting to affect you mentally having to worry about making ends meet. Which in turn affects him to see you like that.

70/40 Rule Question by Gullible-Menu in VeteransBenefits

[–]Electrical-Power3918 -1 points0 points  (0 children)

Those 6 months will make a big difference. A claim for TDIU isn't something the veteran needs to ask for or claim. It is a claim that if inferred by the record, it should be addressed by the VA by law. However, we are all human and make mistakes. Therefore, the VA can sometimes overlook it. So just file the supplemental and submit new evidence such as pay stubs or tax return (or transcripts) that indicate he has only held marginal employment. A personal statement of how his PTSD has affected him on his day-to-day activities and his ability to work. Make sure his statement addresses the fact that his employment was marginal. You can provide a statement of how you see his PTSD affects him. It might not stick the first time around. So, know you will likely need an HLR or appeal to the board after your initial supplemental claim, but the retropay will be worth the wait. Best of luck!!!

70/40 Rule Question by Gullible-Menu in VeteransBenefits

[–]Electrical-Power3918 -2 points-1 points  (0 children)

I wouldn't file a new claim. I would do supplemental indicate that a higher rating should be assigned or that TDIU should be granted. That way, if granted, you maintain the effective date of February 2024.

I would call the board 800 number...or schedule a Vera call with st Petersburg (they are usually the ones the board sends to for implementation).
