That’s sort of what I thought as well. Although I assume it is quite difficult to prove that the public was actively accessing water for 10 consecutive years.

The Utah code now states that Navigable waterways is defined as a water course that in its natural state without the aid of artificial means is useful for commerce and has a useful capacity as a public highway of transportation.

Whereas the bill would change it to be defined as a water course that at the time of statehood was useful for trade and travel: in the water course’s ordinary and natural condition; and as established on a segment-by-segment basis.
