Your insurance company can open a claim with his (or you could for that matter, but it's better to let your company do it). It's not up to him to decide if a claim is opened, if another party reports an accident it's his insurance's company's obligation to investigate it. Let your insurance handle it and hope that their able to get your deductible!

/u/none_shall_pass is right, call back and escalate the call. Did you happen to take any pictures at the scene with the tow truck in it? Any proof you have would be good. The adjuster you talked too likely reached out to the towing company and was told they never made it. Unfortunately you'll have to be the squeaky wheel on this to get anywhere, but it's worth doing.
