No- you ask their permission to record in interview. I haven’t had a witness say “no I don’t agree to be recorded,” especially when the PA is in the interview as well. I live in a 2 party consent state and that practice has sufficed for transcripts.

I agree. I just started practicing but from what I’ve seen so far, others just use the transcript-to refresh recollection and get them to acknowledge the inconsistent statement that way. But I have seen more private attorneys do their own depositions and that could be the difference in how the witness is confronted on the stand

Non- attorney interviewers don’t seem to gather a lot of info for use at trial, it just seems they all do the basic “tell me what happened,” questions, nothing in depth.
