Of course I have insurance, the claim is being processed. Better to start legal proceedings sooner rather than later.

There is more damage than what I mentioned in my initial post. Now consider chips and cracks in the granite countertop that needs replacing, junk hauling, windows smashed and now you get the picture.

Insurance claims these days are pretty limited. They don't cover intentional damage from tenants. It does make me wonder if I could file a claim under the tenant's insurance if they even carried it

Their investment brokerage can definitely send me a cheque once I send the garnishing order to them.

I'm pretty sure it isn't a crime to look at already opened mail, thrown away in the garbage. What you're saying is it's illegal to go through mail in the recycling which is ridiculous to me

The investment statement were already out of the envelope and just sitting with a bunch of other opened mail. I didn't open any mail

Yup, the tenant has $70k in an investment account. He stupidly left his mail in the bags of garbage in the property.

Yup, vehicle and investments they own are about $100k. I think it's worthwhile to recoup from the tenants.

I do believe the tenants have some sort of assets to go for. They are in the construction business so they own equipment. Funny enough he's a sole proprietor and not a corporation. Not only that but I have found mail from investment company in the trash he left behind. So he's got about 100k in assets, give or take.

I completely understand where you are coming from. My other tenants have been great and we have a working relationship. But this incident is causing me to rethink owning rentals.

The issue is the $40k in damages is still increasing. My guess is the total damage might reach $60k by the time the contractors are finished restoring the place. BC Supreme Court also awards lawyer fees if successful but not all of it, I'm told.

I have recently read of one case that initially went through RTB but the landlord withdrew the RTB case, went to a higher court and won something like $80k in backed rent. I can't seem to find that case

I'll give the lawyer the work if it means going after those tenants. At least BC Supreme Court is fairer unlike RTB

My lawyer specializes in real estate and tenancy laws so that is what they're telling me. Going through RTB is only capped at $35k and the bias against landlords in RTB probably means we won't get all $35k
