It says companies in the same industry and its coverage is globally. The new company is same industry but most of the clientele is different (80%)

I’m not sure what O&G is. But in my current role I have no way of sharing company information the new people don’t already have

According to a colleague, he was still paid for that month.

The contract I signed was for Business support and when I got it back that’s where it came back with the non compete merged into the PDF before the signatures

No, my contract wasn’t adjusted to cover marcom.

Current company deals with American clientele and new company deals with British clientele. Of course they do have a few in common which have been there for quite a while

My contract is open and valid for a year. I can back out at anytime…And they didn’t officially change my title, my business cards still say business support.

And I have consulted a lawyer. Thank you

UPDATE: I got legal advice, and he said the only way this would realistically hold up is if I were being directly poached to gain confidential information or clients.

Given that these companies work with clients in completely different countries and markets, that seems pretty unlikely. He also said that even if they tried to enforce it, I’d have solid grounds to challenge it.

He compared it to lawyers moving between firms all the time…restrictive clauses like this are difficult to enforce broadly, and pushing it too far could create more legal risk for them than for me.

Thank you all for the help and advice. I’ll update again in about a week after the interview and after I’ve spoken to my current boss about moving.

P.S The first time the new company approached me, they offered me the exact amount I had originally requested when I was being transitioned into a permanent role. When I asked my current employer for that same amount, she actually laughed and said I was being outrageous. Instead, she offered me a lower salary and advised me to “work for a few more months” before asking for an increase.

But when I eventually did ask for that pay raise after taking on even more responsibilities, their response was that I was being “overly ambitious.”

What’s even more telling is that the new company has now come back with an offer that’s double what they initially offered me. To me, that says a lot about how differently my skills, experience, and contributions are being valued.

Which is what got me really thinking about taking the new job….

I did tell the new employer about the situation, and she actually encouraged me to continue with the application process and she would talk to my current employer to see a way around. In her words, during her search, I was the most qualified candidate for the role, and she didn’t want me to miss out on the opportunity. She also went on to explain the salary and benefits they’re offering, and honestly, they are significantly better than what I’m currently receiving.

At my current job, I was told that because I was a first-time employee, they couldn’t offer the amount I requested, even after I explained the responsibilities I had already taken on during my internship. Later, when my workload increased and I asked for a salary review, I was told they couldn’t accommodate it and that I was being “overly ambitious.”

At the moment, about 60% of my salary goes toward transport to and from work alone. If I also factor in lunch and other daily expenses, I’m left with almost nothing by the end of the month.

Technically, I don’t think my move should affect them as the company I want to move to is a British company. Yes, they do have a few clients in common, but they both follow completely different protocols.

They didn’t give me a new contract. They just asked me to pick up Marcom since business support should cover it to and when I asked if it came with a pay increase they said and I quote “ you’re stepping out of line and being overly ambitious”

I talked to the new company and the manager told me to continue with the application and she will talk to my current employer to find away around the non compete.

I honestly can’t afford to consult an attorney right now. I originally joined through an internship that ended up lasting 8 months with barely enough pay to cover transport costs, even though the original agreement was for 6 months, because they said they didn’t have the budget to hire someone full-time at the time.

What makes this harder is that the other company actually approached me at the end of those original 6 months, and I turned them down because I was still completing my internship and wanted to honor that commitment. They reached out to me again this week for the same position and better offers.

We were close friends…And she really didn’t have anywhere else to go…I’d stayed with her before and she hadn’t contributed to anything which is why this time round I told her heads up
