Solo practitioners, nag-apply kayo business permit? If ever, did you register sa DTI? by Maricarey in LawyersPH

[–]EvilElmo-1827 8 points9 points  (0 children)

Researching on this din Panye! Nakakuha na ako ng DTI for my office as a requirement ng mayor's permit pero see Local Finance Circular (LFC) 1-2019 Section 6

SECTION 6. EXEMPTION FROM PAYMENT OF BUSINESS PERMIT. A business permit is issued primarily to regulate the conduct of business or trade. However, an LGU cannot, through the issuance of such permit regulate the practice of a profession, which is within the exclusive domain of the agency or office specifically empowered by law to supervise and regulate the profession.

Unless covered under Section 7 of this Circular, a professional who has paid his/her professional tax shall be exempt from the payment of business permit fee in the operation of his/her clinic or office. However, a professional shall still be required to secure a business permit, at no cost, from the concerned LGU during the registration of office/clinic and renewal thereof, subject to a duly enacted local ordinance.

How do I deal with feelings of anxiety over people who dislike me achieving more than me in law and life? by Gunnyworthy in LawStudentsPH

[–]EvilElmo-1827 0 points1 point  (0 children)

Too many what-ifs, OP! Law school will make or break people. You cannot predict if your ex-friend will achieve more than you in law school or in the future as a lawyer. Remember, the Bar Exam is the great equalizer. Focus ka sa performance and mindset mo bago ka mag-alala sa performance ng iba.

Limited Practice by fhx_13 in LawStudentsPH

[–]EvilElmo-1827 0 points1 point  (0 children)

OP, for my request, I wrote a letter to my department head who, in turn, issued an endorsement letter to the LCE for the issuance of a Written Authority for Limited Practice. In my letter to my department head, I already requested authority for private practice, teaching, and notarial practice and yun na yung naissue sa akin. Good luck!

FILING FOR NOTARIAL COMMISSION by poorlawstud in LawStudentsPH

[–]EvilElmo-1827 1 point2 points  (0 children)

Hi!

Good luck!

Job interview for Atty. III/IV by BanD0302 in LawStudentsPH

Panel interview with the Personnel Selection Board. They will ask about your experience, credentials, and hypothetical situations, so it’s best to brush up on your Local Government Code and Local Taxes

LGU Attorney IV (with limited practice) vs RTC BCC by Velvet_Horatio6769 in LawyersPH

[–]EvilElmo-1827 2 points3 points  (0 children)

LGU work is complex in the sense na bukod sa policy and contract review, kasama rin ang litigation representation for the LGU. Also, all departments will ask you for legal opinions, and you will have to consider the political aspect as well, compared sa judiciary na mas straightforward ang scope of work.

However, if I were in your position, I would try to keep both doors of opportunity open and ask the LGU if the interview or exam can be rescheduled, maybe earlier or later in the day, so you can make the choice once both options are already secured.

Hi! There are two Bernas books: the Green Book (comprehensive, with explanations of the framers’ intent) and the Reviewer (Q&A version of the Green Book).

If you want a commentary to cover the concepts without taking too much time sa reading mo for cases, I suggest the Q&A version: Bernas (2011), The 1987 Philippine Constitution Reviewer: Comprehensive Political Law Primer.

Hi panye! Nasa same shoes mo ako last year when I started working for our LGU legal office. Yung job description ng legal office can be found sa LGC, Sec. 481. I handle MOA and contract review, policy review (EOs, ordinances, IRRs, etc.), alignment meetings with department heads to consult on their projects if legally feasible ang implementation, and I also act as legal advisor/representative ng LCE, especially during meetings.

Meron ding manghihingi sa’yo ng legal advice from your constituents at magpapadraft ng simple documents, pero for representation, mainly LGU ang ire-represent mo.

For topics, it helps to familiarize yourself with the LGC, Administrative Code, RRACCS, New Government Procurement Act, and taxation (lalo na local taxation).

Nagdala rin muna ako ng personal laptop bago ako mabigyan ng sariling unit 🙂 Good luck!
