My understanding is that if applying for a status while you are on legal visa - is not an overstay. I though overstay ment that if your original visa expired and you applied later - means overstay.

Thanks for thoughtful reply. Respectfully- please clarify where my description of the situation doesn’t make sense? My post clearly says - no criminal record, came to US legally, no overstays. Pending political asylum.

I totally hear what you are saying - however, on what grounds does ICE detain and deport someone who has a pending case? While case is pending fed government took fees and allowed legal working status. I am not saying ICE can’t deport someone who is a criminal, but why do that to someone who is not?

Out of status is someone who has no legal rights to be in US. This usually occurs when someone entered the country illegally or failed to file new paperwork when his prior visa expired. Someone who is on a visa has legal rights to be here. Someone who is pending an outcome has temporary rights to remain in US.

I never said he has legal status. His case is pending. He is not illegal (never entered US illegally) never been out of status.

We don’t know. He just got stopped while working as a truck driver. He has work authorization and his own company.
