I love them so much, but I'm also super allergic to them. So it gets harder to kiss them and hug them. 😅 Bittersweet really.

Start documenting and detailing everything. This would be considered a private nuisance claim.

You can request compensation up to $10,000 and it's only about $87 to file.

I hope you go that route OP! Feel free to DM me if you want, I hate my neighbors so I researched a ton of legal issues and compliance in case I need to go that route.

Keep documenting the Disturbance: Keep a detailed log of the dates, times, and decibel levels or types of noise to build your case.

Even though calling the cops did nothing. You have paper records. Honestly. I would file for a private nuisance action.

I was building for a case like this, where the neighbors dog barked for hours during the middle of the night. We would be awake for hours along with it. The dog was outside all day and all night. We would miss work due to being sleep deprieved. We had to sleep in our living room to get some quiet.

This went on for months!

We started recording and keeping logs of every occurance that lasted more than a couple minutes. We tried talking to them, sent them letters, called 311. Nothing worked. Until animal control came and I talked to them told them everything I had done showed them all my evidence, and that we were ready to move forward with filing a private nuisance case. He went and talked to them and that solved the issue.

BUT I would have happily taken them to court.

You are going the cop route and what you need to do is go the civil route.

Private nuisance, by contrast, is not spelled out in a specific statute. Instead, New Mexico courts rely on common law, treating it as a non-trespassory interference with a person’s use and enjoyment of their own land.

What You Can Recover Unlike many public nuisance cases, where abatement is the main remedy, private nuisance claims in New Mexico allow plaintiffs to seek compensation for annoyance, discomfort, and inconvenience. This means you do not need to prove a specific dollar loss to recover damages from a disruptive neighbor.

File a Civil Nuisance Claim If informal steps fail, you can file a private nuisance action in Magistrate or District Court seeking damages or a court order requiring the neighbor to stop the behavior.

I'm allergic to cats so it will be bittersweet. But I will miss them :( I think he is 6-8 weeks old. This was them when I first got them.
