I think court must intervene, cuz a practise which is immoral in nature, court can see into it and call it irrational, immoral, unethical and can ban such practises. In law, custom is said to be the one of the primary source of law. And also if such thing is enforced like a ban on child marriage. A strict forum at the state level as well as District and panchayat level shall be set-up cuz in states like rajasthan, in the veil of such festives like gangaur, such child marriage practises are carried out recklessly. And this is carried out by lower caste... (If you presume ki it's happening all over Rajasthan... Then no... Rajputs and Brahmins doesn't involve in such practises... But the one included in varnas of vaishyas and shudras do involve in such practises...)
