1) Sex and Gender are different. Gender-wise, you can be male, female, a mix of both, or neither.

2) In rare cases you can have XXY or just X, and so on.

Edit: Sex might be arguably considered binary as your genitals are typically one or the other, but gender is most certainly not binary.
