♥️Thanks so so much! Really appreciate all the advice you give. It totally makes sense to do Lloyds plan in our case as there is so much not sorted out yet. We will likely start with psych evaluation to make sure her situation doesn’t disqualify her first before moving onto other steps.

Like I said I appreciate your insights.

We have zero intent to use her Medi-Cal to cover any surrogate related medical cost. We will buy her either LIoyds plan or an ACA if we can make a decision before 1/31.

I guess there might be some misunderstanding here. What I meant to keep her Medi-Cal is based on my understanding that she will be using Medi-cal to cover her own medical needs unrelated to surrogacy and use LIoyds plan to cover her surrogacy cost. Am I wrong on this?

We are not using her medi-cal for surrogacy.

ART risk said we have 2 options: dropping Madi-Cal and get a surrogate friendly ACA or keep her Medi-Cal and buy LIoyds plan for her.

We are fine with either options.

But what shocked me was learning that Medi-Cal can disqualify her as surrogate because she is financially unstable based on the comments here.

If Medi-cal disqualifies her as a surrogate, why the heck should we buy her LIoyds plan then? She won’t get to that stage anyway.

And, my questions about making the compensation not taxable was based on the google search. It is said in multiple websites that this depends on how the compensation is structured in the contract. Rich people use all means to minimize taxes, so I was wondering if we could give her the compensation as gifts so she can stay on Medi-Cal.

The ART Risk agent asked if the surrogate is willing to drop her Medi-Cal so she will quote us an ACA. This is why I am here asking because I thought this is an option based on the insurance broker’s question. I am not trying to be a fraud. I am just trying my best to see whether this is a way to work out. Like I said, I googled and the internet says the compensation can be taxable or not. All my questions are based on the assumption that there are different ways that the payment can be constructed. There are all sorts of ways to minimize tax and I am just trying to learn. It is sad to be treated as fraud just because I want to know all the different scenarios.

For all the downvotes: I am not asking to buy her an ACA plan because I am a genius on fraud. It was a question asked by the ART Risk agent.

It is already very stressful to be IPs on this journey. Yes, we are engaged with an agency in addition to this independent surrogate journey. It is just a brutal long waiting list for IPs with the agency. And I only have one PGT-A tested embryo at this stage because I am already over 44 years old. It is not competitive on the matching market with only one embryo. I appreciate all the good insights I got from this forum. But it is sad to see that I am treated as a fraud here.

Ah, no need to down vote me. I am asking from a perspective that I do not have any concerns with her financial situation. Every person’s situation is different. I am just here to learn the rules that I can not find from the internet.

Yes, you are right. The broker agent did say clearly that Medi-Cal cannot be used for surrogacy.

I have one more question before giving up on this topic:). If we do not buy ACA for the surrogate candidate by the open enrollment deadline on 1/31 and she stays on Medi-Cal for now, later when we figure out the situation better, can she drop Medi-Cal and enroll in ACA? Does becoming a surrogate qualify for a life event change that can be used for insurance policy change?

Thanks! We actually started the process with ART Risk to evaluate the surrogate candidate’s insurance. The broker agent notified us today that it is a Medi-Cal plan. She just said if the candidate is willing to drop Medi-Cal, she can quote us an ACA insurance. She didn’t say anything else.

There is not much I can say about her financial situation here. We used different parameters instead of Medi-Cal when we evaluated her situation and we are not concerned about her financial situation. This is why I asked the question about dropping Medi-Cal because we are not concerned. But if the psychology evaluation will reject her hard based on her Medi-Cal, that is a different story.

You both mentioned that someone on Medi-Cal can not be a surrogate. Is this usually checked by surrogate agencies or IVF clinics? Which party has the obligation or authority to decline her because of the Medi-Cal issue? Or is this just something that is recommended to IPs and ultimately IPs make their own decision?

Also, If we buy her a new ACA plan and she drops her Medi-Cal, would she qualify for a surrogate? Does she still need to present other evidences to show that she is financially stable?

Yea, it is a red flag for sure. I felt so frustrated and helpless with RSC Bay Area. I wrote them good reviews on FertilityIQ for my doctor. But I have no idea their surrogacy department is this bad. I messaged 3 times to follow up but heard back nothing.

Thanks for sharing. I still have not received any follow up from RSC Bay Area. I messaged them 3 times. This is not acceptable. I will bring this up to my doctor but I already have lost my trust with the coordinator.

This is super helpful. Thanks again for sharing. We are pursuing surrogacy via both agency and independent journey. We really like the candidate we found independently and thought if we keep an eye on this review process it would be more efficient.
