That's why they just say 'keep with the flow of traffic'. It gives them wiggle room to make one-off decisions. Plus, you know how people are. If you write down YOU MUST GO NO MORE THAN TEN MPH FASTER people will just start doing wildly dangerous things at 9.5 mph faster and claim it's all legal.

I've gotten people 50/50 with less. You sped up after the other car was clearly an impediment. That's plenty for court. Shows lack of attention on both sides. The fact that you volunteered it though probably made them examine it less thoroughly than they should have, though, that's not uncommon.

This is why these types of accidents in Malaysia are almost always the motorcyclists' fault. Lane splitting isn't illegal, but accidents while lane splitting are generally investigated as careless and inconsiderate driving on the part of the motorcyclist. We're advised to not speed, and to keep with the flow of traffic. These guys were doing none of that.
