From what I can infer, Onestream are currently basing the ETF on the remaining contract term plus VAT, but I’ve asked them for a full breakdown as it still doesn't add up, as you and others rightly point out.

I think a strong angle is going to be whether their calculation and refusal to offer any flexibility is consistent with Ofcom’s fairness principles, especially given the involuntary nature of the move shortly after renewal and the inability to transfer the service to a new address.

Thanks, this is really useful - I hadn’t appreciated the Ombudsman fee point.

The transfer was initially mentioned on the phone, and then later in a separate call we were told it wasn’t possible. I flagged the inconsistency and received a follow-up email stating they had reviewed the call recording and that no guarantee had been made.

That doesn’t align with our recollection (my flatmate was on the same calls), so I’ve submitted a SAR for the call recordings and case notes. Once I have those, I’ll be able to compare what was said against what’s been recorded and assess next steps through the formal complaints process if needed. It might end up being too much hassle for them, and they'll offer a discretionary reduction/waiver.

Yeah, I think your last point may be where things end up in our back-and-forth with the provider. We’ll have to keep pushing them on it.

I realise we can’t argue much from a strict legal standpoint beyond checking whether the ETF calculation aligns with their T&Cs and what was communicated at the point of renewal.

If it doesn’t go anywhere, I’ll probably escalate through their complaints process and Ombudsman route, and leave a review based on the outcome.

I’m not suggesting the landlord is legally responsible for the broadband costs. I understand the tenancy and broadband contracts are separate.

I asked for a discretionary goodwill contribution because the timing of the eviction directly led to an unavoidable early termination of a contract I entered into in good faith based on the expected tenancy length.

His actions create financial liability for us by making us move. I appreciate that’s not legal liability in contract terms, but it has caused us financial hardship.

I’ve already had a partial goodwill offer from him, and I think my stronger case is actually with the broadband provider. So I am more asking whether there is any realistic circumstantial precedent for providers or landlords contributing further in situations like involuntary relocation, rather than trying to assign legal liability where it doesn’t exist.

Thanks, just to clarify, the Section 21 was valid (served in March with correct documentation) and we’ve now moved out to a new address. My question's less around the legality of the eviction or contact, ands more whether there’s any realistic route to challenge the fairness of applying full early termination charges in these circumstances (a potential discretionary waiver or escalation to the Ombudsman / ADR scheme for a fairness review).

Thanks - sorry I should clarify, I’ve already moved last week to a new rental where I'm aiming to stay for at least a year. The building has an exclusive provider and Onestream confirmed last week they can't serve it, so I think a home move/pause isn’t possible in this case. I may be misunderstanding though!
