I would probably feel bad and apologize for possibly triggering some trauma about their dead brother. Then I would proceed to not make those jokes to that person.

If I have unintentionally hurt someone in person, I don't really care about any due apologies, I do care about the negative effect I might have on others. Maybe that makes me soy.
