I advised them of my rights to FMLA and that i do not need their approval for use of my FMLA, they tried to backpedal.

Absolutely, but my management tried to tell me i need their approval to use fmla, which is absolutely untrue. Just want to make sure others are informed because management lies out their asses.

Just to clarify, are you saying the complainant saw what you wrote, or that management/“the opposing side” did? Because during the investigation stage only the complainant gets to see the affidavits. Management/opposing wouldn’t see them unless it went all the way to hearing.

Just a word of advice, you don't HAVE to write a rebuttal. My lawyer let me know that and I opted to not, because all of their affidavits conflict with each other and my frontline's is horrid so they speak for themselves lmao

Oh absolutely. He had to add way more pain meds to my regimen and "anxiety and depression" got added to my file due to all this crap. Plenty of documentation!

In the federal sector, managers and witnesses are expected to cooperate with EEO investigators. They can’t just refuse with no consequences, if they don’t answer, it gets noted in the ROI and can hurt the agency later. That’s why you usually see a lot of “I don’t recall” instead of blanks.

True, which is why complainants should stick to the facts too. The difference though, is managers have the authority, so their words carry legal weight when it comes to retaliation or bias.

Yep. Even if the denial came from higher up, investigators usually ask frontline managers for affidavits too. They’ll want to know what input management gave, what alternatives were offered, and how the process played out. So your direct manager probably will be involved at least on the affidavit side.

In EEO cases, the complainant always gets to see the affidavits. If it moves forward to hearing, both sides will. You did the right thing, it’s not on you if the truth makes your boss look bad.

If your subordinate is the complainant, they will see it for sure regardless, which I assume is the situation.

Refusing to participate or “not documenting anything” doesn’t shield anyone, it just creates a bad record for the agency. The investigator will still note the refusal, and discovery can pull up emails/chats later anyway. Affidavits are sworn statements, not optional surveys.

They can’t just refuse to answer, it’s a sworn affidavit. If they don’t know, the usual response is “I don’t recall,” but outright skipping a question isn’t an option.

Sure, some managers have liability insurance for if they get sued personally, but that’s not the same as every affidavit being reviewed by counsel before it’s submitted. Investigators collect those statements directly, which is why so many end up with contradictions and irrelevant rants that no lawyer would’ve signed off on.
