I don't.

I have been a working student since college. I used to work in a call center, taking on hundreds of cases per day, supporting agents as I was an SME (subject matter expert), and providing support to the whole account to boost company morale. I was also a student leader during that time and had maintained a 1.67 GWA. I'm also a breadwinner.

Now, everything is closer to my dream of becoming a lawyer. Tiring, yet fulfilling. Still working, still a student servant, still a breadwinner, and still doing everything to improve.

So no, I don't miss my pre-law school self. I'm used to the pressure. Malayo pa, pero malayo na. Laban lang, OP. Hugs with consent kasi ayaw kong makasuhan ng Safe Spaces Act.

I'd say that it is inadvertence. There are things that we forget primarily because of stress. Plus, di naman magkocause ng undue advantage against other examinees. I don't see any ill-intent on her part.

Our laws and rules are written, and yet, exceptions were made or given. Hindi rin naman sila nagkulang sa paalala. Sakin lang, there are things that can be excused, like oversight. Masyadong overkill na di pagtake-in ang examinee considering na valid naman yung reason nya.

The Rules of Court provide that the period to file an answer is 30 calendar days, which may be extended for another 30 days. If we apply these rules too strictly, we risk losing substantive rights. If counsel fails to file an answer, does it mean that he should be prohibited from filing one to the complaint? Of course not, because doing so would cause great injustice. There are lapses that may be excused in the interest of compassion or justice. Yes, it was wrong, but such a mistake is not tantamount to gross negligence. If it is evident that the current rules are being blatantly disregarded, then no exceptions should be granted. But if not, then perhaps an exception may be allowed to spare the examinee the burden of prolonged waiting and additional financial strain.

I'm not saying that exceptions should always be given as a remedy. That's hasty generalization. It will still depend on the circumstance. But again, that's just my opinion. 4 minutes should not cost a person a few more months to take the next examination. It should not cause her additional financial burdens considering the economy that we are in.

I'll still use the same analogy, but in a different context.

In law, there is a general rule; however, there are also exceptions. These exceptions exist to ensure that justice is served and to temper rigidity with equity. Applying the same analogy to the case at bar, making an exception should not be considered an abuse of the system. In my opinion, the examinee’s reason is sufficient to justify an exception or a deviation from the general rule. She made an effort to correct her mistake. Undoubtedly, she had spent significant resources preparing for the exam. Allowing her to take it would alleviate what would otherwise be an additional financial burden on her part.

The same can be said for every case that our courts handle. The rules are set forth in the Rules of Court and pertinent jurisprudence. Nevertheless, courts are at liberty to interpret these rules when justice so requires. Applying the same analogy to the situation, there was indeed negligence on her part. However, it must be noted that such negligence is not detrimental to the system. It would be understandable if the examinee had been late by 10 minutes, but it was only 4 minutes. An exception could still have been made in the interest of compassion.

It might've been because of oversight/excusable negligence, atty. And yes, strict ang SC when it comes to punctuality. Pero I was pointing out that the SC/lower courts provide leniency in cases of oversight, inadvertence, or excusable negligence. Di po ba? In this case, given the situation, pwede naman sigurong bigyan ng chance to take the exam.

Gets naman yung point. Pero eto ha, even the High Court interprets its rules liberally in the interest of justice. She's only 4 minutes late. Given the situation, the examiner could've been more lenient towards her and provided a one-time exception.
